As an independent non-profit corporation, the Center for AI and Digital Policy will bring together world leaders, innovators, advocates, and thinkers to promote established frameworks for AI policy – including the OECD AI Principles and the Universal Guidelines for AI – and to explore emerging challenges.

    📢 Council of Europe Launches First Global Treaty for AI (Sept. 5, 2024) 🎉 🎉 ➡ The Council of Europe AI Treaty seeks to protect fundamental rights, democracy, and the rule of law ➡ The Framework Convention was signed today by Andorra, Georgia, Iceland, Norway, the Republic of Moldova, San Marino, the United Kingdom as well as Israel, the United States of America, and the European Union. ➡ Norway stated it would apply the AI Treaty to both the private and public sectors and urged other countries to do the same 🗣 COE Secretary-General Marija Pejčinović Burić said, "I hope that these will be the first of many signatures and that they will be followed quickly by ratifications, so that the treaty can enter into force as soon as possible." 🗣 Theodoros Roussopoulos, president of the COE Parliamentary Assembly, hailed the AI Treaty "as a major step forward" and urged its entry into force as soon as possible 🗣 CAIDP President Merve Hickok said, "The Council of Europe AI Treaty centers the protection of fundamental rights, democracy, and the rule of law in the governance of Artificial Intelligence. CAIDP has worked in support of the AI Treaty from Day 1. Although we did not achieve all the outcomes we believe are necessary, we urge states to sign and ratify the Treaty as soon as possible. The conference is hosted by the Minister of Justice of Lithuania, Ewelina Dobrowolska.     📓 New CAIDP Article on The Need for AI Redlines As governments develop AI governance frameworks, establishing prohibitions for unsafe AI systems should be a top priority for policymakers, write Christabel R. and Marc Rotenberg of the Center for AI and Digital Policy for Tech Policy Press. "Consensus is emerging that such prohibitions are essential for safe, secure, and trustworthy AI." Christabel and Marc describe the recent history of prohibitions on AI systems, focusing on human rights and public safety, and the role of the United States. 🔥 "In 2019, former United Nations Human Rights chief Michelle Bachelet urged the prohibition of AI systems that fail to comply with international human rights norms. Her call influenced the UNESCO Recommendation on AI Ethics, which explicitly prohibited the use of AI for mass surveillance and social scoring– a practice where some governments assign a secret score to their citizens based on their compliance with government-established norms. 🔥 "The European Union Artificial Intelligence Act includes prohibitions on certain AI systems, establishing several red lines, including restrictions on the use of AI for biometric categorization based on sensitive characteristics and untargeted scraping of facial images from the internet to create facial recognition databases. 🔥 "President Biden said, 'My Administration cannot—and will not—tolerate the use of AI to disadvantage those who are already too often denied equal opportunity and justice. From hiring to housing to healthcare, we have seen what happens when AI use deepens discrimination and bias, rather than improving quality of life.' The White House 🔥 "In the global policy realm, the United States backed the Council of Europe AI Treaty that urges countries to consider the need for moratoriums or bans on AI systems incompatible with human rights, democracy, or the rule of law. "Of course, red lines are not new to US policymakers. Federal agencies have routinely established prohibitions on unsafe products to promote public safety. In 1988, the U.S. Consumer Product Safety Commission banned lawn darts after the game caused just a few deaths. Waiting for the bodies to pile up before acting would have been a dereliction of duty for an agency charged with public safety. "No motor vehicle is sold in the United States without undergoing extensive safety testing. So, it is hardly surprising, then, that AI governance frameworks establish obligations for those who develop and deploy AI systems throughout the lifecycle and, in some instances, prohibit certain AI systems altogether. 🔥 "The United States and several other countries have established AI safety institutes to monitor the development of advanced AI systems.     This week CAIDP President Merve Hickok visited Under-Secretary-General of the United Nations , and United Nations University Rector Tshilidzi Marwala チリツィ マルワラ [丸笑] at his office in Tokyo. The visit is also part of Hickok’s Council on Foreign Relations - Hitachi International Affairs Fellowship and her collaboration with Chiba Institute of Technology. Prof Marwala brings a unique perspective - as an AI scientist, educator, human rights advocate and as someone who has lived in different cultures. The conversations, also joined by Chief of Staff Michael Baldock, covered a wide range of topics on global AI governance: -Recent TICAD ministerial meetings (Tokyo International Conference on African Development) -Data Free Flow with Trust (and how to achieve trust) -United Nations role in global AI governance and the upcoming Summit for the Future, and Global Digital Compact -Importance of incentives which shape human, corporate and national behavior -CAIDP’s contributions to global AI policy to advance human rights.     📢 First International AI Treaty Open For Signature - September 5 On 5 September 2024 in Vilnius, the Council of Europe Convention on AI, Human Rights, Democracy, and the Rule of Law will be opened for signature under the Lithuanian Chairmanship of the Committee of Ministers. 🇱🇹 Key provisions include ➡ Activities throughout the lifecycle of AI systems must comply with the following fundamental principles: - Human dignity and individual autonomy - Equality and non-discrimination - Respect for privacy and personal data protection - Transparency and oversight - Accountability and responsibility - Reliability - Safe innovation ➡ Remedies, procedural rights and safeguards - Document the relevant information regarding AI systems and their usage and to make it available to affected persons; - The information must be sufficient to enable people concerned to challenge the decision(s) made through the use of the system or based substantially on it, and to challenge the use of the system itself; - Effective possibility to lodge a complaint to competent authorities; - Provide effective procedural guarantees, safeguards and rights to affected persons in connection with the application of an AI system where an AI system significantly impacts upon the enjoyment of human rights and fundamental freedoms; - Provision of notice that one is interacting with an AI system and not with a human being. ➡ Risk and impact management requirements - Carry out ongoing risk and impact assessments in respect of actual and potential impacts on human rights, democracy and the rule of law; - Establishment of sufficient prevention and mitigation measures as a result of the implementation of these assessments; - Possibility for the authorities to introduce ban or moratoria on certain application of AI systems (“red lines”). Many CSOs participated in the development of the AI Treaty.     📢 Draft UN Global Digital Compact (rev4) Now Online (Aug. 27. 2024) The most current version of the draft Global Digital Compact has been posted online. The UN Secretary-General António Guterres launched the GDC Initiative in 2021 to “outline shared principles for an open, free and secure digital future for all." The GDC is expected to be adopted at the Summit of the Future in September 2024. In 2024 comments on the GDC, the Center for AI and Digital Policy urged participants to: ➡ Establish a UN Special Rapporteur for AI and Human Rights ➡ Establish a Scientific Panel on AI ➡ Ban Lethal Autonomous Weapons Systems (LAWS) ➡ Implement the Universal Guidelines for AI as the basis for the global governance of AI CAIDP, "Statement to the UN Global Digital Compact on AI and Human Rights," (Aug. 5, 2024) In 2023 comments to Amb. Anna-Karin Eneström and Amb. Claver Gatete on the GDC, the Center for AI and Digital Policy recommended ➡ the United Nations encourage member-states to adopt democratic, transparent processes on developing Artificial Intelligence (AI) governance frameworks, and ➡ assess and report on the impact of AI on the fundamental rights set out in the International Covenant on Civil and Political Rights / Universal Declaration of Human Rights, including: - Article 1 (Self-Determination), - Article 9 (Liberty and Security), - Article 10 (Inherent Dignity) - Article 12 (Freedom of Movement) - Article 14 (Fair Trial) - Article 17 (Privacy) - Article 18 (Freedom of Thought) - Article 20 (Disinformation and Incitement to Violence) - Article 21(Peaceful Assembly) - Article 22 (Freedom of Association), and - Article 26 (Equal Protection).     📢 UNESCO Launches Open Consultation on New Guidelines for AI Use in Judicial Systems "UNESCO’s recent survey of judicial operators worldwide has highlighted a significant lack of institutional guidance and training on the use of AI systems. In response, UNESCO, in collaboration with international experts, has developed draft Guidelines for AI use in Courts and Tribunals. “The guidelines, shaped by the UNESCO Recommendation on the Ethics of AI, aim to ensure AI technologies are integrated into judicial systems in a way that upholds justice, human rights and the rule of law." UNESCO survey found that ➡ +35000 judicial operators participated in the UNESCO Global Judges Initiative ➡ 160 countries impacted ➡ 44% of respondent judges use ChatGPT and other LLMs for work purposes ➡ Only 9% of them receive training or have institutional guidelines in place ➡ 92% of them call for mandatory regulations & training The draft Guidelines for AI use in Courts and Tribunals is based on UNESCO’s Global Toolkit on AI & the Rule of Law. The UNESCO Toolkit is for national judicial training institutions, universities, and other legal education organisations.     📢 CAIDP Advises California Assembly on AI Training and Data Transparency In comments to Jacqui Irwin, Chair of the California Assembly Committee on Cybersecurity, the Center for AI and Digital Policy provided detailed recommendations on Assembly Bill 2013 "AI and Training Data Transparency." CAIDP also commended Rep. Iriwn for her leadership in establishing basic "transparency requirements for developers of AI systems and services." CAIDP wrote, "Consequential decisions in high-risk use cases like employment, housing, and lending rely on black box techniques can produce unaccountable, opaque and often unfair results. California has taken the lead in establishing guardrails for AI and if the bill is successful, we could see the same frameworks replicated in other states. 🔥 CAIDP urged California lawmakers to adopt a definition of AI systems that does not exclude automated decisionmaking systems. CAIDP endorsed the Federal Trade Commission definition which states that "AI includes, but is not limited to, machine-based systems that can, for a set of defined objectives, make predictions, recommendations, or decisions influencing real or virtual environments." ➡ CAIDP also recommended "public disclosure of the explanation or logic as well as the results of independent impact assessments of algorithmic decision systems." Algorithmic transparency, CAIDP wrote, is the "foundation of trustworthy and human-centric AI." ➡ CAIDP also recommended that high-risk use cases include AI systems that produce "adverse impacts on fundamental rights." 🔥 CAIDP warned "With A.I.’s ability to amplify risk to a catastrophic scale, waiting until harms emerge may be too late. We support your effort to develop transparency measures to ensure accountability of AI systems.
