On Oct. 11, the U.S. District Court in Alexandria, VA held a hearing for preliminary injunction in Community Associations Institute v. U.S. Department of Treasury. CAI anticipates a ruling on the request shortly. This case is a critical component of CAI’s effort to protect community associations from burdensome requirements mandated under the Corporate Transparency Act. The legal team; including Phoebe E. Neseth, Esq., Damon Wright, Clair Wischusen, Brendan Bunn and Edmund Allcock represented Community Associations Institute member interests' well!

As part of Chadwick, Washington, Moriarty, Elmore & Bunn, P.C.'s continuing efforts to educate community associations on complying with the federal Corporate Transparency Act (“CTA”), we are pleased to offer additional informational resources – specifically, step-by-step guides for: (1) beneficial owners and company applicants to obtain their own FinCEN Identifiers, which can then be provided to the person or company that is completing and filing their association’s Beneficial Owner Information (BOI) Report; and (2) filing the association’s initial BOI Report. We also previously posted CTA FAQs for community associations. The following resources can all be found on our website at the link below: (1) Our “How to Guide” for obtaining a FinCEN Identifier, (2) Our “How to Guide” for filing the initial BOI Report (for community associations incorporated/created prior to January 1, 2024), (3) Our “How to Guide” for filing the initial BOI Report (for community associations incorporated/created on or after January 1, 2024), and (4) Our “Frequently Asked Questions” document regarding compliance with the CTA by Virginia and D.C. community associations (homeowners’ associations and condominium unit owners’ associations). https://lnkd.in/eCTQMU9y
