🗳️ Tomorrow's election will reshape the future of college sports and NIL policies. Republicans and Democrats have different visions for athlete rights, collective bargaining, and NIL control. Check out the below to see how each party's stance could impact the future of college athletes. Front Office Sports put together a great article summarizing the differences and providing insights on what’s at stake for athletes and fans alike. 🔗 https://lnkd.in/ebNUdvuE Check out this Instagram post for a summary of the key differences: https://lnkd.in/gezhrERp #CollegeSports #NIL #2024Election #Republicans #Democrats #AthleteRights #FrontOfficeSports

Great overview of the Oklahoma State Brand Squad and how it can be a win-win for the marketing students and the student-athletes who don't necessarily have large scale agent representation. Not all school athletic departments have been as open to giving this sort of access and responsibility to academic departments or adjacent clubs. Many school athletic departments choose to keep this type of consultation in-house to ensure their in control and aware of what guidance their student-athletes are receiving. This excerpt summarizes well the mutual benefits for all involved: "The program pairs teams of marketing students with OSU student-athletes to help them develop and enhance their personal brands. This innovative approach not only provides students with practical experience but also equips student-athletes with the tools and knowledge to capitalize on NIL opportunities." #NIL #nameimagelikeness #NILeducation

Good read below from Danica Zelvin about the (continued) request from the NCAA for federal intervention on Congressional intervention. NCAA President Charlie Baker dedicated a social media post after the Matthew Sluka debacle with a call to action for Congress to intervene: "While we’d love to see these resources used to protect student-athletes in every NIL deal, it’s not something the NCAA has the authority to mandate. In the meantime, we’re continuing to advocate for Congress to create national NIL guidelines that will protect student-athletes from exploitation, including the use of standard contracts." With the election on the horizon, it's likely that Congress has other priorities between regulating the NIL landscape. However, over the last few years, Congress has introduced multiple bills pertaining to NIL. Here's a list of recent NIL bills that were introduced at the Congressional level and what happened to them: 📜 Name, Image, and Likeness (NIL) for International Collegiate Athletes Act 👨⚖️ Introduced by: Senators Pete Ricketts (R-NE) and Richard Blumenthal (D-CT) 🖋Description: This bill aims to allow international student-athletes to access NIL opportunities by amending F-1 visa regulations, which currently restrict NIL activities. 📅Date Introduced: October 17, 2023 Status: Referred to the Committee on the Judiciary Enacted into Law: No 📜 Protecting Athletes, Schools, and Sports Act of 2023 👨⚖️Introduced by: Senators Tommy Tuberville (R-AL) and Joe Manchin (D-WV) 🖋Description: This bipartisan bill seeks to standardize NIL rules across the nation, establishing a uniform framework for college athletes to profit from their name, image, and likeness. It also addresses issues like athlete employment status and long-term health care. 📅Date Introduced: July 25, 2023 Status: Referred to the Committee on Commerce, Science, and Transportation Enacted into Law: No 📜 College Athletes Protection and Compensation Act of 2023 👨⚖️Introduced by: Senators Cory Booker (D-NJ), Richard Blumenthal (D-CT), and Jerry Moran (R-KS) 🖋Description: This draft legislation aims to create a uniform national law for NIL, providing college athletes with the right to profit from their personal brands while ensuring protections such as long-term health care and academic support. 📅Date Introduced: July 20, 2023 (discussion draft released) Status: Pending formal introduction as a bill Enacted into Law: No 📜 NIL Discussion Draft by Senator Ted Cruz 👨⚖️ Introduced by: Senator Ted Cruz (R-TX) 🖋Description: This discussion draft seeks to codify NIL rights for student-athletes, providing legal certainty for colleges and universities. It also addresses the roles of universities, conferences, and athletic associations in NIL deals. 📅 Date Introduced: August 3, 2023 (discussion draft released) Status: Seeking public feedback before formal introduction Enacted into Law: No

Amidst the demands of senior year, it can be difficult to find the time to do what I enjoy most – exploring the world of Name, Image, and Likeness. However, I always take great pleasure in writing for Conduct Detrimental, and was able to squeeze some research and writing in. Last month, NCAA President Charlie Baker expressed a desire for the implementation of federal NIL legislation to combat the trend of exploitation we’ve seen recently. In my latest article for Conduct, I described how this legislation could have prevented recent controversies and the potential advantages of federal guidelines. https://lnkd.in/e6jDMmNa

Great post-mortem from Michelle Meyer about a lost opportunity for the AVP to leverage local NIL deals for a mutually beneficial partnership. In January 2022, Opendorse and Front Office Sports published a paper, evaluating some of the key facts and figures of NIL from the first six months of NIL activity from July 2021 to December 2021 and cited that 34.3% of deal spending came from local brands. Michelle spells out a hypothetical promotion strategy with local NIL partnerships that other brands/professional sporting events could leverage when hosting events near college towns. #NIL #nameimagelikeness #localNIL

As most people know, I am deeply passionate about beach volleyball becoming a sustainable professional sport in the United States and a recent event really got me thinking: Last weekend, our professional beach volleyball tour, the AVP, hosted their new league format on campus at San Diego State's Viejas Arena. While an incredible location, I knew getting anywhere close to the ~12,500 capacity through the doors would be a challenge. If I'm being honest, I'm not even sure there are that many beach volleyball fans in San Diego, overall. For the AVP (and other Olympic sports leagues) to grow and become sustainable, it's imperative that they reach non beach volleyball audiences and nurture new followers into becoming lifelong fans of both the sport and organization. Is there a better opportunity to do this than NIL partnerships with college athletes to promote these events? Not only is a high percentage of their audience other college students and members of the surrounding community, but their followers also are more likely to be interested in sports. Check out more in the blog below! Would love to hear your thoughts!

Great insight from Noah Henderson about how the Volunteers' innovative "talent fee" initiative could be perceived by fans. Henderson also walks through the math 🔢of how much the revenue sharing will cut into the profit margins of the athletic department : "In the 2022-23 academic year, the Volunteers athletic department generated $202,097,305 in revenue ... The proposed NCAA direct NIL payout of $22,000,000 is closer to a 90-10 split in favor of ownership when looking at Tennessee’s 2022-23 revenues." Here are the current revenue splits between players and owners in major U.S. sports leagues: NFL: Players get about 48% of league revenue, with owners taking 52%. NBA: Players receive 49-51% of Basketball Related Income (BRI); owners get the rest. MLB: No formal split, but historically, players get about 50% of revenue. NHL: Players and owners split Hockey Related Revenue (HRR) 50/50. These figures are based on the latest collective bargaining agreements.

My thoughts surrounding Tennessee’s 10% NIL “talent fee” on next years tickets has seemed to catch a bit of traction on X (Twitter). People in Knoxville see lavish athletic facilities around campus, sky high administrative and coaching salaries, and a very lucrative media rights deal. Asking hard working fans to subsidize institutional athlete payment after three years of asking them to donate to NIL collectives feels tone-deaf. How far will schools demand their fans stretch their wallets to retain their bloated athletic budgets? My full analysis: https://lnkd.in/gK94mMBQ
