Here’s a quick breakdown: According to the Fair Labor Standards Act (FLSA), time off is not a factor in the calculation for overtime hours. This means that if an employee takes a day off but works 45 hours in the same week, only the hours worked beyond 40 (in this case, 5 hours) are considered for overtime pay.
