About us

The Criminal Division develops, enforces, and supervises the application of all federal criminal laws except those specifically assigned to other divisions. The Division, and the 94 U.S. Attorneys have the responsibility for overseeing criminal matters under the more than 900 statutes as well as certain civil litigation. Criminal Division attorneys prosecute many nationally significant cases. In addition to its direct litigation responsibilities, the Division formulates and implements criminal enforcement policy and provides advice and assistance. For example, the Division approves or monitors sensitive areas of law enforcement such as participation in the Witness Security Program and the use of electronic surveillance; advises the Attorney General, Congress, the Office of Management Budget and the White House on matters of criminal law; provides legal advice and assistance to federal prosecutors and investigative agencies; and provides leadership for coordinating international as well as federal, state, and local law enforcement matters.

    Major Enforcement Operation in Guatemala Secures Arrest of Human Smuggler Indicted by Joint Task Force Alpha for Links to 2022 Mass Casualty Event in Texas On Wednesday, extensive coordination and collaboration between the Justice Department and its domestic and international partners resulted in a major enforcement operation that dismantled a human smuggling network based in Guatemala. In June 2022, this network smuggled people into the United States on a journey that ended with the deaths of 53 migrants in a tractor-trailer in San Antonio, Texas. Twenty-one of the deceased migrants were Guatemalan. This case is part of Joint Task Force Alpha (JTFA), created by Attorney General Merrick B. Garland in June 2021, in partnership with the Department of Homeland Security to strengthen U.S. enforcement efforts against human smuggling emanating from Central America. On Aug. 21, Guatemalan law enforcement executed multiple search and arrest warrants across Guatemala, working together with United States law enforcement agents. At the request of the United States, Guatemalan authorities arrested Guatemalan national Rigoberto Ramon Miranda-Orozco, who has been indicted in the Western District of Texas in connection with the investigation. Six individuals arrested as part of the operation will be charged locally in Guatemala. Miranda-Orozco, 47, whose indictment was unsealed today, allegedly conspired with other smugglers to facilitate the travel of four migrants from Guatemala through Mexico, and ultimately, to the United States. He allegedly charged the migrants, or their families and friends, approximately $12,000 to $15,000 for the journey. The indictment alleges that three of these migrants perished in the tractor-trailer, and the fourth suffered serious bodily injury. Miranda-Orozco is charged with six counts related to migrant smuggling resulting in death or serious bodily injury. He faces maximum penalties of life in prison. “Over the past two years, the Justice Department has worked methodically to hold accountable those responsible for the horrific tragedy in San Antonio that killed 53 people who had been preyed on by human smugglers,” said Attorney General Garland. “With these arrests, the Justice Department and our partners in Guatemala have now arrested a total of 14 people for their alleged involvement in this tragedy. We are committed to continuing to work with our partners both in the United States and abroad to target the most prolific and dangerous human smuggling groups operating in Mexico, Guatemala, El Salvador, Honduras, Colombia, and Panama.” Read more: https://lnkd.in/g6JkUTF3

    Former U.S. Representative George Anthony Devolder Santos pleaded guilty today to committing wire fraud and aggravated identity theft. In pleading guilty, Santos, 36, of Queens, New York, admitted he filed fraudulent FEC reports, embezzled funds from campaign donors, charged credit cards without authorization, stole identities, obtained unemployment benefits through fraud, and lied in reports to the House of Representatives. “As part of his campaign for election to the U.S. House of Representatives, George Santos committed fraud and identity theft, and lied to the American people about his personal finances and campaign supporters,” said Principal Deputy Assistant Attorney General Nicole M. Argentieri, head of the Justice Department’s Criminal Division. “In doing so, Santos violated laws designed to ensure that the public has accurate information about the personal finances of individuals who seek to represent them in Congress and how their political campaigns are funded.   • Foreign National Charged for Selling Counterfeit Cancer Drugs A federal grand jury in Houston returned an indictment today charging an Indian national with selling and shipping tens of thousands of dollars’ worth of counterfeit oncology pharmaceuticals into the United States. According to court documents, Sanjay Kumar, 43, of Bihar, India, and his co-conspirators allegedly arranged for the sale and shipment of fake, counterfeit versions of oncology pharmaceuticals—including Keytruda—to individuals in the United States. Genuine Keytruda is a cancer immunotherapy that is approved in the United States for 19 different indications, including to treat certain types of melanoma, lung cancer, head and neck cancer, Hodgkin lymphoma, gastric cancer, cervical cancer, and breast cancer. Merck Sharp & Dohme LLC, formerly known as Merck Sharp & Dohme Corp., has the exclusive right to authorize the manufacture of Keytruda for introduction into interstate commerce. Kumar was arrested on June 26 in Houston after traveling to the United States to conduct further negotiations aimed at expanding his business selling fake Keytruda in the U.S. market. Kumar is charged with one count of conspiracy to traffic in counterfeit drugs and four counts of trafficking in counterfeit drugs. If convicted, he faces a maximum penalty of 20 years in prison on each count.     Man Sentenced for Sending Death Threat to Michigan Election Worker An Indiana man was sentenced today to 14 months in prison for sending a communication that included death threats to an election worker in Michigan shortly after the November 2020 election. “The Justice Department has no tolerance for violent threats against election workers, officials, and volunteers, and as this case demonstrates, we will aggressively investigate and prosecute such threats to the fullest extent of the law,” said Attorney General Merrick B.     National Health Care Fraud Enforcement Action Results in 193 Defendants Charged and Over $2.75 Billion in False Claims The Justice Department today announced the 2024 National Health Care Fraud Enforcement Action, which resulted in criminal charges against 193 defendants, including 76 doctors, nurse practitioners, and other licensed medical professionals in 32 federal districts across the United States, for their alleged participation in various health care fraud schemes involving approximately $2.75 billion in intended losses and $1.6 billion in actual losses. In connection with the coordinated nationwide law enforcement action, and together with federal and state law enforcement partners, the government seized over $231 million in cash, luxury vehicles, gold, and other assets. “It does not matter if you are a trafficker in a drug cartel or a corporate executive or medical professional employed by a health care company, if you profit from the unlawful distribution of controlled substances, you will be held accountable,” said Attorney General Merrick B.
