Sometimes, reality is scarier than the movies. This article highlights some of Hollywood’s horror movie inspirations. A spooky read, indeed. This has people asking some questions: - Who benefits from these stories turned to film? Writers are often protected by the First Amendment when creative expression is inspired by real-life stories. And the Son of Sam law (notoriety-for-profit law) prohibits criminals from financially benefiting from the publicity of their crimes. - What about the victims? Can their estates benefit from their role in the story/crime? Possibly, it depends on the situation. How did Universal come to own the iconic version of Frankenstein’s Monster? The Frankenstein story was written in 1818, but missing in the story was a description of the Monster; Mary Shelley left that up to the readers’ imaginations. The story itself fell into the public domain, but in 1931 Universal created its own iconic Frankenstein movie based on the book, depicting the tall flat-topped, green-skinned, scarred monster with bolts in the neck that we all recognize today. While Mary Shelley’s story remains in the public domain, Universal’s version, including its depiction of the Monster, is protected by a copyright owned by Universal. So, while anyone is free to create a retelling of the Frankenstein story, the Monster himself would have to look a whole lot different than the iconic version we all know. Ever heard of a creator's "termination right"? The case of Horror Inc. v. Miller highlights this unique aspect of copyright law. Under Section 203 of the Copyright Act, in certain circumstances, creators can reclaim their rights. That’s exactly what the original Friday the 13th screenwriter did! When the film production company protested, the Court ruled that the screenwriter was an independent contractor at the time the script was written and therefore could successfully terminated Horror Inc.’s rights to the screenplay. This case is a powerful reminder of the importance of understanding copyright ownership, work for hire, and the rights that creators can exercise.
