On September 30, 2024, CMV Law attorneys Mark Meyer and Melissa Lynott Mitchell secured a defense verdict for an Illinois hospital and podiatrist after a six-day trial. The case involved a 54-year-old female patient with a history of plantar fasciitis. She underwent an open fasciotomy and gastrocnemius recession surgery in 2018. Post-operatively, she began experiencing numbness in her lower extremity and was ultimately diagnosed with sural nerve entrapment. In 2019, the podiatrist performed a second surgery to attempt to decompress the sural nerve and treat tarsal tunnel syndrome, another nerve entrapment that developed after the first surgery. The plaintiff alleged that the podiatrist should not have been near the sural nerve during the first surgery and that the tarsal tunnel syndrome was present and should have been addressed at that time. Additionally, the plaintiff claimed that a cast placed after the first surgery was too tight, causing injury to the common peroneal nerve, which led to further numbness and motor deficits. The plaintiff sought $5.5 million in damages. The defense argued that sural nerve injury is a known risk and recognized complication of a properly performed surgery, that the tarsal tunnel syndrome developed after the first surgery due to altered biomechanics in the plaintiff's foot, and that the cast was appropriately placed. The jury returned a defense verdict in favor of the hospital and the podiatrist. This marks CMV Law's 23rd defense verdict since September 2023.

On September 23, 2024, CMV Law attorneys Marni Slavick and Tom Lang secured a defense verdict for a Chicago-based general surgeon in the Circuit Court of Cook County after a week-long trial. The case involved a 63-year-old female patient, a fitness instructor diagnosed with diverticulitis and a severe abdominal infection. She underwent a laparoscopic-assisted colon resection performed by the defendant at a local suburban hospital. Post-operation, she experienced left leg weakness and loss of sensation, later diagnosed as a left femoral nerve injury requiring neurological and orthopedic treatment. The plaintiff alleged improper positioning in the stirrups during surgery led to the injury and sought nearly $1,000,000 in damages. The defense argued that a left femoral nerve injury is a known risk in such abdominal procedures and presented evidence of proper patient positioning throughout the surgery. The Jury returned a verdict in favor of the defendant surgeon.

On August 30, 2024, CMV Law attorneys, Scott Herbert and Marisa Brunetti, successfully obtained a defense verdict on behalf of an otolaryngologist and his practice group following a weeklong trial in DuPage County. The plaintiff alleged that the defendant's otolaryngologist failed to perform a repeat fine needle aspiration, unnecessarily performed an excisional biopsy procedure, and could not obtain distal and proximal control of the jugular vein during the biopsy. The plaintiff claimed to have suffered a permanent vocal cord/nerve injury related to bleeding from a tear in the internal jugular vein, which occurred during the dissection of a neck mass. The defense argued that the otolaryngologist appropriately took steps to obtain a definitive diagnosis, including performing an excisional biopsy. Additionally, the defense presented evidence that the standard of care did not require obtaining distal and proximal control of the jugular vein during the procedure. In closing arguments, the plaintiff's attorney requested the jury award $1.5 million in damages.

CMVLAW congratulates Michael Slovis and Blair Kipnis who successfully defended a general surgeon and large hospital network in a wrongful death case that involved the alleged failure to timely secure the patient's airway resulting in arrest, hypoxia, and death. After a three-week trial in the Circuit Court of Cook County, the jury returned a verdict in favor of all defendants. The plaintiff's demand during the trial was $6.3 million. This was CMVLAW's 4th not-guilty verdict in 10 days.
