CMVLAW congratulates Michael Slovis and Blair Kipnis who successfully defended a general surgeon and large hospital network in a wrongful death case that involved the alleged failure to timely secure the patient's airway resulting in arrest, hypoxia, and death. After a three-week trial in the Circuit Court of Cook County, the jury returned a verdict in favor of all defendants. The plaintiff's demand during the trial was $6.3 million. This was CMVLAW's 4th not-guilty verdict in 10 days.

On July 18, 2024, CMV Law attorneys Anne Kuban and K. Scarlett Olson obtained a defense verdict on behalf of their clients, a local hospital and two general surgeons following a 15-day jury trial in the Circuit Court of Cook County. The patient was a 74-year-old woman who had a history of severe peripheral vascular disease. The patient elected to undergo an aortobifemoral bypass surgery with a vascular surgeon. Following surgery, there was a concern for bowel ischemia. The general surgeons performed exploratory laparotomies on two separate occasions. During both surgeries, the bowels were found to be viable. The patient's condition subsequently deteriorated, and she died. Plaintiff claimed that both general surgeons should have ordered CT scans of the abdomen, and that had a CT scan been performed, a bowel resection would have been completed and the patient would have survived. The defense contended that a CT scan was not necessary, and it would not have shown anything that was not seen directly in surgery. The defense presented evidence that a bowel resection was not required when the bowels were inspected on two separate occasions, and they were found to be viable in surgery. The defense further contended that the patient died from liver failure. In closing argument, the plaintiff attorney asked the jury to award $2,550,000 in damages to the surviving adult children. #CMVLaw

CMV Law attorneys Tom Lang and Luke Piercy successfully obtained a defense verdict in favor of a local orthopedic surgeon and his practice group following a weeklong trial in Cook County. Plaintiff claimed that the defendant surgeon failed to properly obtain his informed consent prior to performing a lateral retinacular release as part of a planned arthroscopic knee surgery to treat a torn meniscus. Plaintiff claimed that he was never told of the possibility of a release, and that it was fully different procedure from the one planned, with significantly greater risks and complications. Plaintiff further claimed that the lateral release caused joint instability in the knee and mal-tracking of the patella, resulting in permanent pain complaints in the knee. The defense introduced evidence that the patient was advised prior to the surgery both verbally and in the written consent for the procedure that the arthroscopic surgery could be expanded to include additional treatment based on the intra-operative findings. Furthermore, the defense introduced evidence to demonstrate that the surgeon confirmed intra-operatively that there was mal-tracking of the patella present, indicating the need for the lateral retinacular release to correct the condition and to help guard against future arthritis which could result from the condition. The defense further introduced evidence that the lateral release could not and did not worsen the plaintiff's condition and was not a competent cause of any of the plaintiff's ongoing pain complaints. In closing arguments, plaintiff's attorney asked the jury to award $1.2 million in damages. #CMVLaw #DefenseVerdict
