    In the TV game show "Who Wants to Be a Millionaire?," a panicked contestant could ask for help when stumped by a question. The game show offered each contestant three "lifelines": (1) 50-50 (which removed two incorrect answers); (2) Phone a Friend (wherein the contestant could call a friendly expert); or (3) Poll the Audience. Of the three "lifelines," the most accurate — by far — was the last option: Poll the Audience. The Audience selected the correct answer an astonishing 91% of the time. Why? Because collaborating with — and aggregating information from — crowds of people generate more accurate answers. Do you want to win?

Today, DataGavel is pleased to announce the recent appointment of Rick Rufolo as Chief Strategy Officer. A seasoned legal executive, Mr. Rufolo served 3.5 years as Executive Director of Georgia Legal Services Program (GLSP), a not-for-profit organization, and 30 years at United Parcel Service (UPS), where he acted as Deputy General Counsel for the Labor, Employment and Litigation Practice Group. During his tenure at UPS, Mr. Rufolo and his team successfully managed complex global litigation across the enterprise, including, among other risks, all auto liability, premises liability, and other tort litigation. With deep knowledge of the more-for-less challenge facing C-suite executives, in-house legal departments, and risk professionals, Mr. Rufolo is uniquely qualified to implement DataGavel's strategic initiatives and work with subscribers to aggregate data, foster collaboration, and streamline workflows.

    A super-majority of all tort cases resolve in the “shadow of the law” — in secret, using confidential terms that both sides found fair and reasonable. These settlements are not published, nor are they public. But the Plaintiffs’ Bar spends $1B annually for strategic advertisements (Ads) on billboards, TV, and radio — and many of these Ads anonymize confidential settlements. Which settlements are anonymized? Only those that the Plaintiffs’ Bar wants to promote. Does it matter? Absolutely. These Ads drive a critical information asymmetry (since settlement details are confidential) and are one cause of “social inflation,” which is the continued upward creep in the public’s perception of claim value. They “influence the thinking of citizens who may serve on a jury.” See ATRA, “Legal Services Advertising in the United States 2017-2021,” p.3. Agree?

    All analysis requires support. In a 2011 article published in the Journal of Empirical Legal Studies, Jacobson and his co-authors concluded that even "experienced attorneys” managing tort cases involving bodily injury have difficulty accurately predicting jury verdicts "from personal experience alone."

    Verdicts in tort cases are “rare,” “peculiar” and “factually atypical.” They often involve novel legal issues and/or unique facts. Less than three percent (3%) of all cases go to trial, but mainstream media is quick to report about the latest trial verdict if it is sensational or results in a lottery-sized award. Big verdicts are over-reported. Fair verdicts are under-reported. Defense verdicts are rarely reported. When evaluating a typical case involving tort claims, past verdicts, as a general rule, are not useful indicators of claim value. See, e.g., B. Fromm, “Bringing Settlement Out of the Shadows: Information About Settlement in an Age of Confidentiality,” 48 UCLA L. Rev. 663, 668-673 (2001). What is a useful indicator of claim value for a tort case? Past settlements from similar matters.
