📢 New Real Estate Rules in Effect for Buyers and Sellers in Massachusetts 📢 In mid-August, several key practice changes were implemented that affect Realtors and real estate transactions. Here's a quick summary of what buyers and sellers need to know: For Buyers: 🏡 Buyers Agents are now REQUIRED to have a signed representation agreement with their clients before touring a property. This agreement is important for Buyers as it outlines agent duties, services provided and compensation. 🔑 Buyer Agent compensation is not widely allowed in MLS (allowed only in certain scenarios) yet can be communicated through various marketing channels including websites and personal outreach such as phone calls or emails. For Sellers: 📊 Listing Agent fees remain negotiable as always. 💡 Seller’s compensation has been decoupled from Buyer Agent compensation. Sellers are not required to offer Buyer Agent compensation; Sellers will decide whether offering compensation is a good strategy for selling their home. Agents are able to advise on what is right for that Seller's situation.
