    UPDATE: Due to to ongoing armed conflict and extraordinary and temporary conditions in Lebanon that prevent nationals of Lebanon from returning in safety, the Department of Homeland Security is announcing a new TPS designation for Lebanon for 18 months. The designation of Lebanon for TPS will allow Lebanese nationals who have been continuously residing in the United States since October 16, 2024 to file initial applications for TPS, if they are otherwise eligible. Lebanese nationals who entered the United States after October 16, 2024 will not be eligible for TPS.     It was once again a pleasure to spend time with Lucine Aghajanyan and Scott talking about Looper Bright, federal litigation, and parole!   I look forward to speaking about parole at UT’s Conference on Immigration and Nationality Law on October 25. Parole is the great “forgiver” in immigration law! “Parole is used precisely as a means of removing bars that would otherwise stand between an alien and government benefits.”  Texas v. Biden, 20 F. 4th 928, 988 (5th Cir. 2021), rev'd and remanded on other grounds, 597 U.S. 785 (2022). One of DMCA’s outstanding lawyers, Kathrine Russell, recently shared with me a legacy INS AAO decision finding that an SIJ recipient deemed paroled who illegally re-entered after removal is not subject to the INA § 241(a)(5) reinstatement bar to relief for having illegally re-entered the United States. Similarly, we have some good arguments that a parole would cure or remove the unlawful entry component of INA § 212(a)(9)(C) for purposes of adjustment. It will be important to develop this argument and identify the right cases in which to raise it. Likely, if we prevail, it will be in a petition for review in a circuit court. Happily, DHS’s position will no longer be accorded Chevron deference.
