According to Census data from August, the construction of over 4 million new residential homes was either started, completed, or granted a permit to begin in July of 2023. This number represents a combination of single-family homes, as well as units for sale in buildings with five or more units. An increase in the supply of new homes in the market is exciting, but it creates challenges for many parties including the companies issuing homeowner insurance policies, homeowner associations as neighborhoods outgrow policies that made sense when there were fewer residents, and key suppliers of elements that make a house a home - like kitchens and bathrooms. The attorneys at Diana Brooks Law are very comfortable in the courtroom, but work very hard to resolve matters without the expense of a trial if at all possible. This year alone we have reached settlements for our insurance carrier clients in suits where: - A guest at a charity golf tournament sued the golf course (our insured) for injuries sustained during a fight which the guest may have started, after the tournament ended; - A driver rear ended a commercial vehicle (owned by our insured) at a red light and then sued the company for damages sustained when they hit the commercial vehicle; - A case where the general contractor (our insured) was sued by the estate of an employee who died on the job after being injured by an employee of a subcontractor; - A case where a cleaning company (our insured) that cleaned the floors of a hospital was sued by a visitor who slipped and fell during a visit to see a hospital patient. Each of these cases may seem like ones where there should be no right to sue. Unfortunately, the reality is that if the damages are great enough, a lawsuit is almost guaranteed regardless of fault because of how easy it is prey on the sympathy of a jury (even if the law is not on the side of the injured) anytime they are hurt badly enough. Although going to trial and getting the validation of a win is rewarding, the risk of a nuclear verdict makes negotiating a reasonable settlement a good business decision.
