Campuses in California have been putting “mask bans” for students into their policies and procedures. Mask bans target student protestors and unfairly harm students with disabilities who use masks for their health and safety. In response to these policies, DRC and Disability Rights Education and Defense Fund (DREDF) collaborated to create Know Your Rights: Mask Bans on California College Campuses. This guide will tell you about your rights when it comes to wearing a mask on campus and to give you information on what to do if those rights are violated. After Governor Newsom acted on the final set of bills for the 2024 session, Disability Rights California is grateful yet concerned. We are grateful to have three sponsored bills, and several other priorities signed in the final few days of September. However, the state continues to move forward with a carceral approach to homelessness and mental health. DRC will continue to oppose these policies and advocate for more affordable accessible housing and voluntary mental health services. In yesterday’s Vice Presidential Debate between Governor Tim Walz and Senator J.D. Vance, the dangerously false connection of mental illness and gun violence was brought up by Senator Vance. We must push back against the idea that gun violence in any space is due to anyone’s mental health disability. False statements like this one add to the stigma that people have toward people with mental health disabilities. This myth has been debunked with data, and disability organizations including DRC have advocated against these types of statements. It is important to remember that disabled people, including those with mental health disabilities are disproportionately more likely to be the victims of gun violence. FACTS: • Mental health disabilities are not effective predictors of violence. • There is no correlation between deinstitutionalization and the number of mass shootings. “Disability Rights California is grateful yet concerned after the Governor’s actions at the end of the 2024 California Legislative Session. Three DRC sponsored bills, SB 445 (Portantino), SB 483 (Cortese), and SB 1197 (Alvarado- Gil) were all signed this past week. These laws will improve the lives of disabled people in a major way. In addition, the Governor signed several other bills improving access for the Deaf and Blind communities. He signed bills to protect people with intellectual disabilities from being given the Death Penalty. However, the state continues to put forward carceral approaches to homelessness and mental health. The Governor signed several laws that will increase penalties for people guilty of certain crimes. Finally, the Governor also signed a law that will allow pregnant people to be placed in solitary confinement. Many of these harmful policies will disproportionately impact Black and Brown people who are poor and disabled. While DRC is proud of the work that our teams and coalition partners continue to do to make California more of a leader, we will continue to advocate against harmful policies that are devastating to our community.” – Eric Harris, Disability Rights California’s Associate Executive Director of External Affairs
