The Supreme Court recently gutted the Chevron doctrine in a seismic ruling. This decision strips federal agencies of the power to interpret regulations as they see fit. The ramifications of this decision will reverberate through the healthcare industry for years to come. As Jenn Kerfoot, Chief Strategy and Growth Officer at DUOS, told Fierce Healthcare, this ruling will impact payors of all sizes. Smaller plans may struggle with the shifting legal landscape. Larger plans have the resources to adapt but must also contend with varying rules across state lines. "How are you, as a health plan, going to be able to create uniform guidance?" Kerfoot asked in her conversation with Noah Tong from #FierceHealthcare. All organizations throughout the healthcare ecosystem should inventory and evaluate how amid change they can create an organizational foundation that will mitigate any member abrasion. Closely monitor legal challenges that can further disrupt the status quo. Be pragmatic in the face of uncertainty.
