Conference Member Derek Baker summarizes the case of In re Smith, No. 23-3418 (3d Cir. May 22, 2024), wherein the United States Court of Appeals for the Third Circuit addressed the res judicata effect of determinations made in plan confirmation proceedings on subsequent proceedings to modify those plans. Thank you to Conference member, Derek Baker, for his summary of In re Mallinckrodt PLC, No. 23-1111 (3d Cir. Apr. 25, 2024), where the United States Court of Appeals for the Third Circuit held that a claim for breach of contract – even “contingent” or “unliquidated” – is still a claim which can be discharged in a chapter 11 plan.

A memorial service will be held on Wednesday, April 24, 2024, at Saint Thomas of Villanova Church (800 E. Lancaster Ave., Villanova, PA 19085). Visitation will begin at 9:00 am with Mass to begin at 10:30 am. Luncheon to immediately follow at the Inn at Villanova University/Montrose Mansion.   In lieu of flowers, the Carey family asks that donations be made to the “Kevin J. Carey Memorial Scholarship Fund” at Villanova University Charles Widger School of Law (299 N. Spring Mill Rd., Villanova, PA 19085).  

The Eastern District of Pennsylvania Bankruptcy Conference is devastated by the passing of Judge Kevin Carey (ret.). Many of us knew Judge Carey when he shined as a practitioner in Philadelphia, and we were excited when he took the bench as a bankruptcy judge in the Eastern District of Pennsylvania. Over the years, Judge Carey contributed to the Conference by serving on a number of our committees, including acting as Co-Chair of the Education Committee. In addition, Judge Carey served as a speaker/panelist at many of our annual Forums. Even after moving his court room from Philadelphia to Wilmington, Judge Carey continued to be generous in giving time to the Conference.
