Out on EDRM's JD Supra Channel, Michael Berman shares his latest article "Service of a “Preservation Notice” in the Forum District Does Not Confer Long-Arm Jurisdiction Over the Out-of-State Sender" Key Ruling on Long-Arm Jurisdiction in Plastics Industry Assoc. v. Bonta A recent decision in Plastics Industry Assoc. v. Bonta (2024 WL 4699927) underscores an important principle: the mere act of serving a "preservation notice" in a forum district does not confer long-arm jurisdiction over an out-of-state sender. 💡 Case Highlights: The D.C. District Court ruled that California Attorney General Bonta’s service of a preservation notice in D.C. did not establish jurisdiction. Jurisdiction requires that the plaintiff’s claims “arise from” the defendant’s forum-related contacts. In this case, the claim arose from the subpoena issued by Bonta, not the preservation notice. Additional alleged contacts, such as a public Instagram page, were deemed insufficient for establishing persistent in-forum conduct. 🚩 Implications for Legal Professionals: This ruling highlights that serving preservation notices across state lines, a routine step in litigation preparation, does not inherently expose the sender to jurisdiction in the recipient’s state. The decision aligns with both the D.C. long-arm statute and the broader Constitutional “minimum contacts” standard.
