Join us on November 6, 2024, from 11 AM to 12 PM PST for a crucial IFA webinar featuring Christopher Friedman, Esq. and Mike G. Silver, Esq., partners at Husch Blackwell. They will discuss the CFPB's new rule under Section 1033 of the Dodd-Frank Act, which introduces "open banking" to the United States. This groundbreaking rule allows consumers and authorized third parties to access and share key financial services data, fostering competition and innovation in the financial services market. For factors and alternative commercial finance companies, this data can significantly improve underwriting decisions, fraud monitoring, and open account management. Don’t miss this opportunity to gain valuable insights into how these changes will shape the future of open banking. This webinar is FREE for IFA Members and Ally Members ($100 for non-members). In today's e-mag, Ben Heuer, Chair of Buchalter’s FinTech and Alternative Lenders Practice Groups, examines two recent developments in California law that are crucial for factors. The amendment to the "junk fee" law allows for expanded charging of collateral monitoring fees, effective January 1, 2025, providing factors with greater flexibility in their pricing structures. Additionally, new annual reporting requirements will require non-licensed commercial financing providers to disclose transaction data, increasing regulatory scrutiny. These changes signify a shift towards transparency and adaptability in the commercial financing landscape. Excited to share my experience at International Factoring Association's 2024 NEXGEN Leadership Summit in Austin, TX! Last month, I joined a group of like-minded professionals, and the energy was contagious. We dove deep into tackling tough leadership choices and explored future trends in our industry. And yes, we also hit the stage at Bull and Bowl for some classic karaoke (and we had too much fun to take a steady photo 😅) Empowering businesses remains my passion, and this summit was a fantastic reminder of the power of leadership and community. Here’s to embracing change and leading with purpose! #factoring #InternationalFactoringAssociation #IFANEXGEN #LeadershipSummit

Thank you International Factoring Association for the invitation to contribute. Five takeaway's from the conversation about the state of the industry.... 1) Sure, factoring companies will compete with each other from time to time. However, the biggest bottleneck to finding clients to support is knowledge and awareness of factoring as an option. 2) Operational excellence is a continual project and process. Amity Mercado provided a valuable handful of lessons learned and examples for her organization. What stood out to me was using an online form template to efficiently document (aka paper trail) exceptions to policy as the decision is being made. Brilliant idea to assist with post-mortems, coaching and senior lender audits. 3) 24 months into a freight recession, the transportation industry is understandably hurting. Transportation is especially cyclical and because factoring is so essential to carriers, consolidation and price competition is uniquely intense. There are still opportunities for nibble, price competitive smaller factors to 'win' by selling service - but it's tough out there. 4) Jacob Ladner did an excellent job providing examples of how factoring companies can help each other - both via participations but also sharing best practices. As we're in the risk management business - and especially with concentration, it's a HIGH risk management business, the phone-a-friend option is especially important. 5) The future is bright! This was the first annual NexGen conference (great job Johnny Bond, Chad Eberly Carson Harmonson, Trishaala Ninan, Tania Daniel planning and executing). My sense is the NexGen conference is a fantastic and cost effective way for early career stage factoring professionals to feel valued by their organization, network/build industry friendship and sharpen skillsets. Onward and Upward !!
