The U.S. Department of Commerce’s Bureau of Industry and Security published a proposed rule that may significantly impact the United States’ automotive marketplace, increase government oversight of the United States’ car supply chain and make American companies less competitive globally. If finalized, the rule would prohibit the sale or import of cars that incorporate certain hardware or software manufactured in countries of concern, specifically China and Russia.

A cross-office intellectual property litigation team obtained a complete defense verdict in a trade secrets case for Lippert. In 2020, Curt Group — a subsidiary of Lippert specializing in cargo management accessories — was approached with an opportunity from a company called Midwest Manufacturing regarding a truck bed extender product. The parties signed a non-disclosure agreement, and after an extended negotiation period, were unable to reach an agreement. In September 2024, the Faegre Drinker team tried the case to a jury, with Midwest arguing for millions on its trade secret, breach of contract and conversion claims. After a 4-day trial in South Dakota's District Court, the jury delivered a complete defense verdict in favor of Curt on all claims. The Faegre Drinker team included Jared Briant, Andrea Savageau, Stephen Osseiran and Theresa T.

Earlier this year, the U.S. Department of Health and Human Services issued a final rule updating certain HIPAA privacy rules concerning the disclosure of protected health information related to reproductive health information. Essentially, the final rule prohibits a covered entity from using or disclosing PHI to conduct criminal, civil or administrative investigations, or to impose corresponding liability on a person seeking or providing lawful reproductive health care. The new restrictions go into effect on December 23, 2024 (and February 16, 2026, for the accompanying new HIPAA notice requirements).
