This summer, U.S. Small Business Administration's Administrator Guzman announced another moratorium extension on the BFO rule. The Bona Fide Office (“BFO”) Rule requires that 8(a) construction contracts “shall be awarded within the county or State where the work is to be performed” (15 U.S.C. 637(a)(11). Per the Moratorium, this rule will not be enforced until September 30, 2025 at the earliest. GovContractPros has learned that the U.S. Small Business Administration recently issued proposed changes to the #HUBZone Program aimed at clarifying comprehensive changes made to the program in 2019. The proposed rule would also make several changes to SBA’s size and 8(a) Business Development (BD) regulations, as well as some technical changes to the Women-Owned Small Business (#WOSB) and Veteran Small Business Certification (#SDVOSB) programs. In this post, GCP offers a summary of some of these proposed changes. In our view, the proposed regulations are a mixed bag; some offer some additional flexibility to federal contractors and in other instances, potentially impose significant costs on federal contractors to maintain eligibility for these programs.
