In Ortiz v. Eversource Energy, a putative class action, plaintiffs brought suit against Eversource Energy alleging that Eversource knowingly marketed natural gas and related services as clean and safe for residential consumers and the environment despite knowing this was not true. Allegedly, Eversource knowingly issued communications that were purposefully misleading and inconsistent with scientific studies. Bornstein, and Vice Chair of GT’s Global Patent Litigation Group, Nicholas Brown, were mentioned in a Law360 article where they successfully defended client TD Ameritrade Inc. After invalidating the asserted patents on summary judgment in the Eastern District of Texas before Chief Judge Gilstrap, they prevailed again on appeal at the Court of Appeals for the Federal Circuit.
