Have you ever agreed to purchase certain services, only to find out later that the quality of those services stinks? I have, and that’s not a fun place to be in, particularly when you’re paying a lot for those services (or lack thereof). This happens to companies all the time (particularly when business teams are under short deadlines) and people ask me after the fact what to do. Unfortunately, because they signed the contract before seeking guidance, they are usually stuck paying the fees until expiration of the initial term, as most vendors do not offer termination rights or other protections in their standard agreement (and why would they). Sometimes companies have to engage a different vendor to do the work right, resulting in payment of double fees. Ouch! Engaging counsel before (again, before) signing on the dotted line can help avoid these sticky/painful situations. Please don’t step over dollars to pick up pennies and perceived speed.
