Congratulations to shareholder Helen Casale and associate Kyle Victor, who helped secure a landmark victory protecting the legal rights of LGBTQ+ parents and families who conceive through assisted reproductive technology. The Pennsylvania Supreme Court on March 20 adopted the doctrine of intent-based parentage, which allows someone to prove legal parentage based on evidence of intent to be a child’s parent, regardless of whether or not there are either biological relations or written contracts in place. Helen and Kyle filed an amicus brief on behalf of the American Academy of Matrimonial Lawyers, which urged the high court to expand parental rights in this closely watched case. A proposed amendment to the Federal Rules of Evidence could expand the use of out-of-court statements by testifying witnesses. If the "under oath" requirement in Rule 801(d)(1)(A) is dropped, prior inconsistent statements made outside formal proceedings will be admissible as substantive evidence.
