Hatch Henderson Fivel's partner, Jennifer Henderson speaks with Law360 about non-equity partners and why they might lateral to another firm. A lateral move to a different firm might create new opportunities for advancement for non-equity partners who feel stuck at the non-equity tier in their own firms. However, elevating to equity through a lateral move is not very common. We do see it sometimes for one of the following reasons: 1) the non-equity partner’s practice/skill set is a strategic need for another firm, and the receiving firm is “recruiting” the partner because of it; 2) the non-equity partner is going to a less prestigious firm, or 3) the nonequity partner has a healthy growing book of business, but their current firm has not caught up with compensation or promotion to equity.
I enjoyed speaking with Brandon Lowrey at Law360 about non-equity partner satisfaction. There has been so much discussion lately around the non-equity partnership tier – which firms have it, which firms don’t, and what that means for those firms and their partners. The non-equity tier serves as an effective recruiting and retention tool. I think it is important for firms to be able to promote stellar senior associates, and partnership promotion is key. Firms that are able to recruit stellar lawyers into non-equity roles (those that might not otherwise be able to join the firm as equity partners) have an advantage attracting junior up and comers. I think that firms implementing the two-tier system just must learn how to strike a balance between paying top-producing partners and retaining up and coming talent (the future “big book” partners) at the non-equity tier.

I was interested to see the results of The American Lawyer's Midlevel Associates Survey. Surveys are always engaging and sort of provocative- after all, some firms win and some lose. Surveys can also be sort of flat, though, if they lack proper context. This article by Dan Roe provides that context.
