Hicks is a conflict-resolution researcher, professor, consultant, and international advisor with nearly 30 years of experience. Shoutout to Gabrielle Hartley, Esq who facilitated a great conversation this morning. Day 2 is shaping up to be a great one.

It's World Mental Health Day, and mental health awareness is an issue near and dear to my heart. This day serves as a reminder that our mental health is just as important as caring for our physical health. As a dispute resolution and legal professional in the divorce world, I am constantly surrounded by individuals (and professionals) who are really going through it. Stress, depression, anxiety, and overwhelm are mental health issues divorce professionals and divorcing individuals frequently experience. If you're stressed, depressed, or overwhelmed, you are going to have corresponding emotions. Journaling is the number one easy, free tool I recommend for anyone going through challenging emotions like overwhelm, depression, grief, or anxiety. Journaling helped me immensely in recent years (in partner with talk therapy and other modalities depending on the season of life). Take some time to write freely on paper or in a word document. Acknowledge your emotions as they arise and name your feelings (“tired,” “anxious,” “isolated,” “worried,” etc.) without judging yourself. The exercise itself can bring some relief. It’s also a great way to check yourself and perform a quick self-assessment. Review your entries. Are they dark? Have you been feeling helpless? There might be signs you should ask for help immediately, or maybe need to contact a therapist to work through larger issues. If you are in crisis, you can get immediate support. If you or someone you know has thoughts of suicide, call, text, or chat 988 to speak with a trained crisis counselor offering support 24/7/365. Prioritize taking care of your mental health today and always. • Mediation can work in your case, even if one or both parties are high-conflict individuals. Navigating high-conflict situations (and individuals) in family law mediation can be challenging, but there are proven strategies to achieve resolution. Here are 7 powerful ways mediation can work wonders, even with the toughest dynamics: 1 - Encourages logical problem solving, shifting focus away from defensive reactions. 2 - Overrides crisis responses, helping everyone stay calm and grounded. 3 - Focuses on analyzing the issues, allowing emotions to settle and logic to take over. 4 - Leverages mirror neurons, promoting calmness and thoughtful problem-solving. 5 - Approaches problems with curiosity, moving the focus from blame to solutions. 6 - Seeks solutions collaboratively, ensuring both parties contribute and feel heard. 7 - Distracts from defensive reacting, transforming the process into a constructive conversation. Mediation is more than just resolving disputes—it’s about creating space for understanding and cooperation. Ready to find your path forward? • Did you know mediation isn’t all or nothing? Mediation can work in just about every case, even if you know there are some issues where you and the other party cannot see eye-to-eye. In mediation, we can help you settle only some or all of the issues in your case. If, after multiple sessions in mediation you can’t agree on one or more issues, you can take just those outstanding issues to the Court for a determination. For everything else, we can help you draft a settlement agreement on only what you can agree on. It’s not “all or nothing.” Using mediation for just some of your outstanding issues can help you save a lot of time and money. The savings could mean thousands of dollars less spent on attorneys and months of waiting avoided. Less litigation also helps keep the peace and enables families to maintain their focus on the children. By keeping one foot in the mediation room, it’s easier to avoid scorched-earth litigation. Mediation helps us communicate better and empathize with the other party, when it is far easier to dehumanize the other side in litigation. Even partially mediating a case is an intentional decision that will positively impact your case, your kids, and your ongoing relationship with the other side. • Certified Divorce Financial Analysts (CDFAs) should be a part of your team of professionals, especially in mediation. Attorneys and mediators usually are not trained to give any kind of real financial advice, which is why having a CDFA is key. CDFAs can help streamline the financial aspects of divorce, which are usually the most tedious (and annoying) for divorcing parties. CDFAs can help the parties come up with creative financial solutions while keeping everyone informed about the tax implications of the settlement. At High Vibe Mediation, we are always happy to refer our clients to qualified CDFAs. We believe that mediators + CDFAs + divorce coaches = the ideal team for an efficient, supportive, and collaborative process. While it may appear there are more cooks in the kitchen, these professionals are trained to create solutions and work as a team. To us, this team is *chef’s kiss*!
