💵 Dirty Dollar Auction Dealings! The US has officially announced #sanctions on Hamad Al-Mouassawi, the owner of Iraq’s Al-Huda Bank, following heightened scrutiny of the financial network backing Iraqi militia Kataib Hezbollah. What's worse: Al-Mouassawi is just the tip of Iraq's dirty money problem. 📣 In January 2024, the US Department of Treasury found that Al-Mouassawi and his bank had been financing Kataib Hezbollah through a #moneylaundering scheme that leveraged a little-known financial mechanism — the dollar auction, which was set up in 2003 to distribute US dollars to banks in #Iraq. In 2015, an Iraqi parliamentarian alleged that Al-Huda Bank had "fraudulently obtained roughly USD 6.5 billion" by manipulating the auction with fake documents, and that it was only one of dozens of banks gaming the system. Washington has struggled to crack down on dollar auction abuse in Iraq, despite having known of the problem for years, while also maintaining financial stability in the country. 🔎 So how does this affect you and your firm? For one thing, it's clear that organizations need to conduct their own #duediligence to stay ahead of US sanctions programs, which can take years to prepare and enforce. #financialcrime #corruption

We all win some and lose some. 💲 Former US IRS agent Tigran Gambaryan is facing a major loss as he sits in a Nigerian jail as a proxy for his employer, #Binance. Last year, Binance was caught in a #moneylaundering scandal, which resulted in the company paying a $4.3 billion #criminal fine to the US government. #Nigeria followed suit and accused Binance of devaluing their national currency, then invited Gambaryan to negotiate the matter. The result: a six-month jail sentence for Gambaryan. 🛑 Gambaryan is now serving time in Nigerian jail without aid from the US government, despite having handled a $4.4 billion #cryptocurrency case for the IRS in 2020 — the largest ever criminal seizure of money to be added to the US federal budget. Will Frentzen, a US prosecutor who worked the historic case alongside Gambaryan and who is now his attorney, commented, “To have him locked up while the US Treasury is collecting $4.4 billion because of his work, it's really twisted.” ✉ In an open letter on June 16, members of Congress called for Gambaryan’s case to be treated as a hostage situation. Frentzen hopes that federal officials who have the power to pressure Nigeria to free Gambaryan will remember where that record sum of money came from.

🏧 #TDBank, the 10th largest bank in the US, made headlines last Thursday after a historic settlement that left them with a whopping $3 billion fine. The Canada-based bank pleaded guilty to conspiracy to commit #moneylaundering, becoming the largest bank operating in the US to do so. According to US Attorney General Merrick Garland, the bank "created an environment that allowed financial crime to flourish,” drawing in criminals left and right. TD Bank executives were allegedly aware of problems with its #AML program but made no effort to correct them and, in some instances, even joked about how easy it seemed to launder money. But we're not laughing; are you? Without #compliance and #duediligence, how are customers and stakeholders expected to trust a bank’s #ethical practices? #financialcrime #banking #finance

💰 Watch out would-be #crypto market manipulators! "Decoy tokens" have added a new wrinkle to #cryptocurrency market enforcement campaigns. This week, federal prosecutors in Boston announced the filing of charges against four major cryptocurrency firms: Gotbit, ZM Quant, CLS Global, and MyTrade. The firms were accused of market manipulation following the deployment of a revolutionary new evidence-gathering tool. The #FBI created its very own cryptocurrency token to attract the services of the defendant firms, which allegedly included executing fraudulent trades to temporarily inflate the value of a given token. ❗ ❗ The defendant entities allegedly manipulated more than 60 tokens to enable their clients to cash out at inflated values, a tactic commonly referred to as a "pump-and-dump scheme." While cryptocurrency markets remain relatively easy to manipulate compared to more traditional ones, this news will hopefully encourage potential criminals to think twice before breaking the law! #finance #compliance #regulatory

👀 ❗ ❗ Check the tag on your H&M, Nike, or Calvin Klein shirt; you may be wearing an item with a controversial past tied to forced labor in #Xinjiang, China. The impact of geopolitical tensions between #China and the West regarding forced labor and #supplychain regulation #compliance in Xinjiang may prove to be an impossible balancing act for Western companies. 👚 Last week, China’s Ministry of Commerce announced an investigation into PVH, the parent company of Calvin Klein and Tommy Hilfiger, for allegedly discriminating against products from Xinjiang province, an alleged hotspot for forced labor. The investigation heightened transnational companies' concerns over doing business in the region, especially since companies in the US, EU, and Canada now face compliance requirements to prove their goods are not produced by #forcedlabor. To make matters worse, the Chinese government has also cracked down on independent investigations and due diligence firms, making it more difficult than ever for Western companies to prove how their goods are produced. Such a dilemma leaves companies re-evaluating how they source their materials and whether to continue joint ventures with companies in Xinjiang.

👷♂️ The construction industry is all about building things: skyscrapers, arenas, factories ... and sometimes, unfortunately, federal corruption prosecutions. Last week, a Miami federal jury sentenced ex-Ecuadorean comptroller general Carlos Ramon Polit Faggioni to 10 years in prison and forfeiture of $16.5 million for his role in a #bribery and #moneylaundering scheme tied to Brazilian construction company #Odebrecht. 💰 Between 2010 and 2015, Odebrecht's business boomed as Polit used his position to remove fines on their projects in exchange for more than $10 million in #bribes. And this isn’t Odebrecht’s first scandal — in 2016, the company was fined $2.6 billion by authorities in #Brazil, Switzerland, and the US after Brazil’s Operation Car Wash, one of the largest corruption probes in history. Odebrecht filed for bankruptcy protection in 2019 and, in a seeming attempt to distance itself from its troubled past, rebranded under the name Novonor.

⛵ Sailing under the flags of countries such as Panama, Palau, #Gabon, Russian oil tankers have quietly circumnavigated Western #sanctions aimed at stunting revenues and preventing prices from spiking. Since July 2023, more than 85 Russian-affiliated ships changed their registrations to Gabon from #Liberia, making the central African nation’s registry one of the fastest growing in the world. However, Moscow’s shadowy efforts have not proceeded wholly unseen. Earlier this year, the US ramped up sanctions enforcement on vessels linked to Liberia and the Marshall Islands, prompting locally registered tankers to swap the stars of one flag for the stripes of another. 🔎 As Russia's war in Ukraine grinds on and sanctions remain in place, #Moscow will likely continue to devise shady ways to sell oil at a profit. #AI is on a roll and compliance officers must keep up! ⚖ This week, the US Department of Justice (#DOJ) announced changes to its Evaluation of Corporate Compliance Programs guidelines, used to assess a company's compliance program when it comes under investigation for #bribery, #fraud, or other criminal offenses. Under the new guidance, prosecutors should ask companies how they use AI and how they approach governance in regard to AI, as well as understand the technology's potential #risks and benefits. The updated guidance emphasizes evaluating companies’ use of #data to ensure compliance with laws and regulations. Companies with good compliance programs can receive more leniency in the event they are investigated for a #compliance breakdown. 🔎 The role of AI and other technologies in compliance is constantly changing and remains an important consideration for all companies.

👩⚖️ Last week, #US federal prosecutors filed criminal charges against two Russian men accused of operating billion-dollar #money laundering schemes and seized websites associated with illicit #crypto exchanges. One of the two, Sergey Ivanov, has a lengthy history in the Russian-speaking underground and has allegedly facilitated darknet drug traffickers and ransomware operators. The crackdown on Russian #cyber crime comes as the #WhiteHouse prepares to welcome Ukrainian President #Zelensky, who is expected to advocate for additional US support in the ongoing Russia-Ukraine war. Despite the US Department of State pleading with Russia to prevent the operation of cybercrime on their soil, the US and Europe have seen little cooperation since the invasion of Ukraine. 🤝 While the Biden administration lauded last week’s charges as a successful transnational disruption of a criminal global cryptocurrency network, the growing challenge of crypto #duediligence remains complex as ever.

⚡ Two months ago, a faulty update to cybersecurity company CrowdStrike’s Falcon platform, which protects against potential #cybersecurity threats, crashed millions of #Windows devices. This historic outage disrupted critical services and business operations across the globe and, in doing so, exposed the fragility of #technology. ✔ The incident now serves as a cautionary tale for corporate #risk professionals who, newly sensitive to #vulnerabilities both within their own organizations and in #supplychains, have turned to third-party risk management (#TPRM) solutions to help grapple with a seemingly unmanageable risk landscape.
