    🎯 OpenAI defeats news outlets' copyright lawsuit over AI training, for now On November 7, a federal judge in New York dismissed a lawsuit filed against OpenAI, alleging that the company improperly used articles from news sources Raw Story and AlterNet to train its language models. U.S. District Judge Colleen McMahon ruled that the plaintiffs had not demonstrated sufficient harm to justify the lawsuit. However, she left room for the outlets to submit a revised complaint, although she expressed doubt about their ability to "allege a cognizable injury." The owners of Raw Story purchased AlterNet in 2018. Matt Topic, an attorney from Loevy + Loevy representing Raw Story, stated that the outlets are "confident we can address the court's concerns through an amended complaint." OpenAI's representatives and legal team did not immediately respond to requests for comment on the ruling. Raw Story and AlterNet initiated the lawsuit in February, claiming that thousands of their articles were used without authorization to train OpenAI's chatbot, ChatGPT, which they allege reproduces their copyrighted content when prompted. This case is among a series of lawsuits filed by authors, visual artists, music publishers, and other copyright holders against OpenAI and similar tech firms regarding the data used to train their generative AI models. The New York Times initiated the first lawsuit by a media organization against OpenAI in December. Unlike other cases, the complaint from Raw Story and AlterNet alleged that OpenAI unlawfully removed copyright management information (CMI) from their articles rather than directly claiming copyright infringement.     🎯 France's Believe denies copyright allegation in $500 mln US claim by UMG On Tuesday, French digital music firm Believe (BLV.PA) refuted allegations of copyright infringement brought by Universal Music Group (UMG.AS), which is pursuing damages of at least $500 million (459 million euros) in a U.S. lawsuit. Universal Music, the largest record label globally, claims in the complaint—reviewed by Reuters—that Paris-based Believe and its U.S. subsidiary, TuneCore, have benefited financially from distributing copies of copyrighted recordings. Respecting copyright is a core value for us, given our global partnerships with artists and labels," stated Believe. "We firmly deny these allegations and the assertions made by Universal Music Group and intend to contest them vigorously." According to UMG, Believe has allegedly distributed copyrighted material by altering artist names or releasing "sped-up" versions of original tracks. The court filing claims that songs by Kendrick Lamar, Ariana Grande, Justin Bieber, and Lady Gaga were distributed by Believe under modified names like "Kendrik Laamar," "Arriana Gramde," "Jutin Bieber," and "Llady Gaga." UMG, ABKCO Music & Records, and Concord Music Group filed the complaint in the U.S. District Court for the Southern District of New York. Believe’s music catalog is available on platforms like TikTok, YouTube, Spotify, and Apple Music. Established in 2005 by Denis Ladegaillerie, a former Vivendi (VIV.PA) executive, Believe went public in Paris in 2021. Now active in 50 countries, the company has grown its market share by acquiring music labels, primarily in Europe, which generates the bulk of its revenue. The company initially aimed to disrupt the music distribution industry by focusing on digital promotion for artists, a strategy that has intensified its competition with major labels.     🎯 US charges Chinese hedge fund executive with trade secrets theft A senior executive at a hedge fund in China has been indicted in the United States, facing charges of stealing trade secrets from his previous employer, Boston-based quantitative investment firm Arrowstreet Capital. Xiao Zhang, 33, was formally charged last week in federal court in Boston. According to the indictment, Zhang allegedly copied his former employer's proprietary code, projects, and research in 2021 to support the operations of his newly established investment firm in China. This indictment is the latest effort by the U.S. Department of Justice to combat what American officials have frequently described as extensive theft of trade secrets and intellectual property by individuals linked to China. The indictment does not disclose the name of Zhang's current investment firm or the identity of his previous employer, described only as a global investment management company where Zhang worked as a research associate since 2015. According to records from the Asset Management Association of China (AMAC), a self-regulating organization for the industry, Zhang was employed in Arrowstreet’s research department from 2015 to 2021 and currently serves as the executive director of Pinestone Asset Management, based in Shanghai. Arrowstreet, a global asset manager, reported managing approximately $177 billion in assets as of 2023, per filings with the U.S. Securities and Exchange Commission. Representatives from Arrowstreet did not respond to requests for comment. Prosecutors stated that Zhang is still at large and currently resides in China, a country without an extradition agreement with the United States. According to data from the Asset Management Association of China (AMAC), Zhang’s firm, Pinestone, manages assets exceeding 10 billion yuan (about $1.4 billion). Neither Zhang nor Pinestone responded to requests for comment on Monday. Bloomberg was the first to report Pinestone’s involvement in the case. The prosecution of Zhang is being handled by the national security division of the U.S. Attorney's Office in Massachusetts.     🎯 Ed Sheeran beats copyright appeal over 'Thinking Out Loud' song On November 1, Reuters reported that Ed Sheeran, along with his record label Warner Music and music publisher Sony Music Publishing, successfully convinced a U.S. appeals court to uphold a previous ruling that his 2014 hit, Thinking Out Loud, did not infringe on Marvin Gaye’s 1973 classic Let's Get It On. The 2nd U.S. Circuit Court of Appeals in Manhattan sided with a lower court's decision to dismiss the lawsuit filed by Structured Asset Sales, which owns the rights previously held by the song's co-writer, Ed Townsend. David Pullman, the owner of Structured Asset Sales and an investment banker, stated that the company was considering its options following the court's decision. Donald Zakarin, the lawyer representing Sheeran and the record labels, expressed that they were "gratified" by the 2nd Circuit’s ruling. Earlier, in May 2023, Sheeran also won a different copyright case brought by the heirs of Ed Townsend, who hold a separate portion of rights in Let's Get It On, after a closely followed jury trial. Structured Asset Sales (SAS) filed a lawsuit against Sheeran in 2018. However, U.S. District Judge Louis Stanton dismissed the case after the jury's decision in the lawsuit filed by Townsend’s heirs. Judge Stanton concluded that the musical elements in question were too commonplace to qualify for copyright protection. The appeals court upheld this view, noting that granting copyright on these elements could hinder creative expression and affirming that Sheeran’s song did not bear enough similarity to Marvin Gaye's work to infringe on SAS's copyright. The appeals court also dismissed the argument that Judge Stanton should have considered Gaye's original recording, which, according to Pullman, contained essential elements allegedly copied by Sheeran, instead of limiting the review to the sheet music registered with the U.S. Copyright Office. Structured Asset Sales has filed an additional lawsuit against Sheeran based on its rights to Gaye’s recording, though that case is currently paused.
