Working in the legal industry is not for the faint of heart. It takes some serious chops to "fight the good fight" while forever remaining abreast of legislative updates, case law, and clients' needs. Even if we try our best, we won't always win -- which is exactly why earned victories are so sweet. Recently, two of our attorneys -- Kelly Guagenty and Paula Bliss -- made valuable inroads while advocating for a local family and its complaint against a statewide athletic organization that initially denied a student-athlete due process rights. The Centers for Disease Control and Prevent (CDC) revealed in a report that adolescent mental health and suicide risk remains a substantial health concern - highlighting that 39.7% of students experienced persistent feelings of sadness and hopelessness, 28.5% experienced poor mental health.... 20.4% seriously considered attempting suicide, and... 9.5% had ATTEMPTED suicide. The staggering statistics have caught the eye of many, including Senators Katie Britt (R; AL) and John Fetterman (D; PA) who have created a bipartisan coalition supporting initiatives that address root causes. To that end, CNN's Jake Tapper recently interviewed the co-founders of Katie's Save, a nonprofit dedicated to improving student safety and well-being on college and university campuses through mental health awareness and suicide prevention. JLC co-founder Kim Dougherty is an avid supporter and outspoken advocate for the organization and its mission. The interview came on the heels of the passing of California Bill 1575 (also known as Katie Meyers Law), which allows students at California’s public colleges and universities to select a trusted adviser to help them navigate any disciplinary process exacted by an institution during their attendance. The legislation is viewed as a valuable starting point. Justice Law Collaborative (JLC), along with co-counsels Berger Montague and Constable Law, P.A., filed class action lawsuits against multiple genetic testing companies for misleading consumers about the benefits and capabilities of the genetic test preimplantation genetic testing for aneuploidy, or PGT-A. PGT-A is advertised as a genetic test that purports to analyze the chromosomal makeup of fertilized human embryos by screening for chromosomal abnormalities. Consumers undergoing IVF are sold PGT-A as an "add-on test" costing thousands of dollars and not typically covered by insurance. The complaints allege that PGT-A is unproven, unreliable, experimental, and inaccurate, information that is not disclosed to vulnerable consumers who are then charged with making critical decisions about which embryos to transfer based on the test results. Paula Bliss, JLC partner and co-founder shared, “Our clients have been forced to make consequential decisions based on PGT-A testing that was falsely marketed as having unproven benefits. LEGISLATIVE VICTORY! 🎉 Before the culmination of Suicide Prevention Month (September), California Governor Gavin Newsom (with powerful support from Assemblymember Jacqui Irwin) signed into law a proposed bill providing an added layer of support to college and university students when faced with disciplinary action or student code of conduct violation. Broadly recognized as the "Katie Meyer's Law," the legislation was prompted after the untimely passing of Stanford University student Katie Meyer, who died by suicide in 2022 after receiving a disciplinary notice from the school. Meyer was a high-achieving academic, who served as a Resident Advisor, a Mayfield Fellow, a Defense Innovator scholar, an ambassador for Just Women's Sports, podcaster, influencer, and as Stanford women's soccer team captain and goalie -- helping the university clinch its NCAA title in 2019. Her loving parents co-founded Katie's Save, an initiative to establish mental health guidance and promote student safety and well-being. The passing of Katie Meyer’s Law offers sweeping change--allotting for students at California’s public colleges and universities the ability to select an adviser to help them navigate the disciplinary process.
