🆕 UPDATE: FTC’s Non-compete Ban Blocked in Federal Court Ahead of Expected Effective Date, Appeals Likely 🔗bit.ly/3WLGXfj On August 20, 2024, a US District Judge in Dallas sided with the plaintiffs in the closely watched Ryan LLC v. Federal Trade Commission, holding that the Rule banning essentially all non-competes violates the Administrative Procedure Act (APA) and exceeds the agency’s statutory authority. Judge Ada Brown concluded that the FTC’s ban is “arbitrary and capricious” within the meaning of the APA “because it is unreasonably overbroad without a reasonable explanation.” The decision in this case will likely be appealed. 🆕 D. Mass. IP Litigation Blog post by Tom McNulty: Nucleus Research Incorporated v. 3Sixty Insights Incorporated (D. Mass. 22-cv-11339). 🔗 https://bit.ly/3LRb8fV Nucleus had accused 3Sixty of common law trademark infringement and unfair competition for publishing reports under the name “Anatomy of a Decision.” Judge Saris had already denied Nucleus’ request for a preliminary injunction, finding the mark was likely descriptive. Judge Saris has now granted summary judgment in favor of 3Sixty, finding that no reasonable juror could find the mark to have attained secondary meaning as required to prove infringement of an unregistered mark. #dmass #iplitigation #trademark #IPLaw
