Big win this week at the Dallas Court of Appeals!
We received happy news from the Dallas Court of Appeals this week. It arrived like a bolt out of the blue, without any warning. Jessica Platt and I tried a wrongful death case in Grayson County in April 2022. It didn't go our way. Among other things, we argued that we didn't owe any legal duty to the Plaintiffs. We thought the law was on our side. The trial court disagreed and let the case go to the jury. The jury found for the Plaintiffs and awarded significant damages. This week, the Dallas COA reversed the trial court's error. The appellate court held that my client did not owe any duty in connection with the premises condition that injured the Plaintiffs. Without a duty, my client was not liable as a matter of law. So, the COA reversed the trial court and rendered judgment in our favor. No retrials, no do-overs--instead, it's a total win for the client! The saga isn't over. I'm sure the Plaintiffs will seek review. But we're now in a much stronger position. Thanks to Rob Gilbreath at HPY for his excellent appellate briefing and performance at oral argument.
