Last year partners Richard Berne and Michael Andreou successfully obtained a defense verdict in Bronx County Supreme Court on behalf of a commercial tenant sued for personal injuries stemming from an alleged slip and fall on ice. The plaintiff maintained a significant seven figure settlement demand throughout the trial before the jury determined that the client’s conduct did not cause the plaintiff’s alleged injuries. The plaintiff appealed, arguing the verdict was inconsistent and against the weight of the evidence, as well as appealed a litany of rulings made by the trial judge as to the admissibility of expert testimony, spoliation and missing witness issues. The Appellate Division, First Department unanimously affirmed the jury’s verdict and all of the trial judge’s decisions. The case is now dismissed.
