I recently had the opportunity to attend the Mass Torts Made Perfect conference presented by Levin Papantonio Law Firm as a law student fellow! Here are my five key takeaways. 1. Invest the time, money, and resources NOW to save time, money, and resources later. By working up cases thoroughly in discovery, we can save time and resources in the courtroom at trial. The jury will appreciate this as well. 2. Use technology to increase the speed of the trial and to increase efficiency in communicating your case to the jurors. Many people are visual learners. Jurors are no different. There’s many ways to incorporate technology in trial using an IPEVO, PowerPoint visuals, and TrialPad and TranscriptPad apps. Dustin Herman you completely opened my eyes on this - thank you! 3. Watch film! Courtroom View Network’s website has video of all the great trial lawyers in the courtroom. As trial lawyers, iron sharpens iron. Watch a Mark Lanier opening or a Randi McGinn closing. Use the techniques you like from various attorneys to make your presentation more effective. 4. Create your own visuals. No one knows YOUR case like YOU! When you create the visuals for the jury, you learn your case better because you must work through different failure modes such as: Does this PowerPoint really communicate the point I’m trying to make? Does this slide simplify what the jury needs to know? When you work through these questions as you create visuals, you become a better advocate for your client. 5. Being a trial lawyer is a lifelong journey. Trial lawyering is not mastered overnight. Law school teaches us to be prim and proper legal "robots" instead of authentic, genuine human beings. Trial lawyers must be aware of this and work to smooth over our approach and communication to the jury. Crack the joke. Smile. Most importantly, be human. VOCs—painful episodes where blood flow is blocked by sickled cells—are already a leading cause of hospital visits for those with sickle cell disease and can lead to serious complications like kidney failure, arthritis, and stroke.
