(NYU), judge at the Commercial Court in Mannheim and currently at the Federal Constitutional Court, Prof. Dr. Lena Hornkohl from the University of Vienna, Dr. Antoine Chapsal, Managing Principal at Analysis Group in Paris, and Niels Frank, a partner at Lademann & Associates in Hamburg, will discuss whether finding a way to deal with the pass-on defense will cost us many more years and whether we can learn anything from other European jurisdictions. The discussion will be moderated by Dr. Katharina Kolb, managing partner of Lieff Cabraser Heimann & Bernstein, LLP in Germany. For many years, German courts have been struggling with the right approach to damages estimation. The pass-on defense threatens to newly prolong cartel damages litigation by several years. Is there a practical approach that balances the interests of plaintiffs and defendants?
