    This morning, Vincent Citro and Alfredo Zamora were prepared to defend our client in a lengthy domestic violence injunction trial against allegations of events that happened in two countries. After filing a motion to dismiss, taking depositions, and obtaining legal documents from a foreign jurisdiction, the petitioner and her attorney dismissed the case yesterday at 4:54 p.m. Defending this matter required our team to coordinate with lawyers in several law firms in another country to ensure the interests of the client and his business were protected in other legal proceedings. Our family law lawyers, Brent Kimball and Karen Middlekauff, often represent executives, professionals, and other high net worth people who find themselves facing injunctions.     The Sixth District Court of Appeal issued Administrative Order 24-01, which will go into effect June 1, 2024, and supersede Administrative Order 23-01 (which already has additional briefing requirements). Initial Briefs are be required to include a statement of the basis for the court’s jurisdiction, “including (a) the basis for claiming that the judgment or order appealed from is final or (b) if nonfinal, the basis for claiming that the judgment or order appealed from is otherwise appealable, including the procedural rule and/or statutory provision upon which jurisdiction rests along with a concise statement of the relevant facts establishing jurisdiction.” As to each issue presented, Initial Briefs must also include a statement as to where in the record or appendix on appeal the issue was raised and ruled on as well as identification of the applicable standard of review. In addition, under the new order, Appellants must include the required information is separate sections of the initial brief listed in the table of contents as “Statement of Jurisdiction” and “Statement of Preservation.” Examples are included as an attachment to the administrative order. Enforcement of the existing administrative order seems to have been inconsistent in the Sixth District.     After receiving an order of dismissal with prejudice in a breach of contract and declaratory judgment action regarding an unpaid referral fee, trial counsel retained appellate and trial support attorney Amie Kozan to draft a motion for reconsideration or rehearing (as the first issue was whether the order was final or interlocutory). That motion was ultimately successful with the court vacating the prior order of dismissal and determining that plaintiff had indeed stated valid claims such that the case could proceed. In short, she won! Losey PLLC regularly partners with law firms on pretrial, trial, and post-trial matters. Our partners rely on us to bring skill, experience and credibility to the courtroom.
