Congrats to Erik Gruber, Jacqueline Figueroa, and Chris Lutzel who successfully obtained a dismissal from Plaintiff at the eve of trial. In the days leading up to trial, our client’s Motion for Summary Judgment was granted in part after Troy Darmanin successfully argued that Plaintiff’s testimony entitled our client to a presumption of prejudice at trial. Michelle Diverio, Eva Camara Garcia, and Alex Sanchez Parraga prevailed on appeal in the Third District Court of Appeal obtaining the affirmance of an order granting the carrier’s motion for summary judgment. The appellant tried to challenge the trial court’s finding that the carrier proved the insured’s material breach of the policy and was entitled to a presumption of prejudice. On appeal, Lydecker’s Property Practice Group rebutted each of the arguments presented pointing to the record evidence and disputed the existence of genuine issues of material fact. The appellate court also granted the motion for entitlement to appellate fees and costs and the carrier now will be able to recover the fees incurred in defending the appeal. Our property practice group, Troy Darmanin and Chris Lutzel run by chair, Michelle Diverio, successfully argued and drafted a Motion for Summary Judgment on behalf of their client. The Judge found that the Plaintiffs did not abide by their contractual obligations under the subject policy and were further unable to rebut the applicable presumption of prejudice applicable in the judicial district.
