❓ Should I have an attorney review my real estate sale agreement before signing? ✔️ The Pennsylvania Association of Realtors (“PAR”) Standard Agreement for the Sale of Real Estate, utilized by most realtors in Pennsylvania, is generally a good form of agreement. That said, there are many choices to be made in completing the form, the impact of which may not be readily apparent to the typical residential seller or buyer. Most realtors are very helpful in completing the PAR Agreement, but they are not lawyers and cannot give legal advice. So, it is never a bad idea to have your attorney review the Agreement before you sign it, especially if there are any unique circumstances, special contingencies or other provisions to be added that are not covered by the form document. ❓ How do I add someone to my deed? ✔️ If you would like to add an owner to your property, you can execute and record a new deed conveying the property from you to you and the other person. However, if you have a mortgage on the property, that would be considered a “transfer” and it may be prohibited by your mortgage. ❓ Do I need my original deed to sell my property? ✔️ No, as long as it has been recorded. Deeds are recorded by the county recorder of deeds and are a matter of public record. When you sell your property, your attorney or the closing company will pull your deed from the county recorder of deeds records. Deeds are not like the certificate of title to a vehicle, which must be an original. While it is good practice to keep your original deed, it is not required to sell your property, as long as it has been properly recorded.
