Doubling down on its anti-noncompete stance, the National Labor Relations Board recently issued a memo expanding on its position to include “stay-or-pay” provisions, building on a 2023 memo specifying the types of activities protected under Section 7 of the National Labor Relations Act that are “chilled” by #noncompete agreements.
