Trust Flexibility in the Granite State We know. “Granite” does not immediately conjure images of flexibility, but under the New Hampshire Trust Code, flexibility is exactly what the Granite State provides to trust administration. In many instances, New Hampshire allows for trust modifications without the need for court intervention and the time and expense. Primary methods of such intervention include Trustee Modification, Non-Judicial Settlement Agreements (“NJSAs”) and Decanting. Brendan Mitchell, Market Street's Vice President and Chief Fiduciary Officer, explores these methods in greater detail in his latest post, “Flexibility: An Advantage Carved in Stone in the Granite State” …

Protection of Assets: New Hampshire’s Trust Code provides additional advantages … In addition to adding further safeguards to the protection of trust assets from creditors, the New Hampshire Trust Code extends the availability of asset protection to all irrevocable trusts containing a spendthrift provision, allowing for self-settled asset protection trusts – trusts from which a settlor may receive benefits while still shielding the trust assets from creditors. In a recent article, Brendan Mitchell, Vice President, Chief Fiduciary Officer, looks into the various asset protections the NH trust code provides.

A key role in the family office team: The Expert Generalist Thank you, Crain Currency, for speaking with Kara Garner Pass, Market Street's President & CEO, about the critical role of the Expert Generalist in providing an exceptional client service experience.
Have you ever heard the expression, "If you’ve seen one family office, you’ve seen one family office." Kara Garner Pass, a well-respected #wealth #management #veteran, took over the reins of the family office of the Houghton family as CEO of Market Street Trust Company in 2019. Pass talks with us today about the importance of having an Expert Generalist, ideally positioned as the Lead Adviser in a family office. Spotting a specialist is generally straightforward but "their expertise, experience, and credentials typically align with specific job requirements." Pass emphasizes that discovering an Expert Generalist is a unique endeavor.
