Marshall Gerstein Patent Agent Qixuan (Vanessa) W. is the latest of our team members to explore the intersection of intellectual property and space innovation. In an IndustryWeek column published recently, Vanessa shares outer space’s challenges and opportunities for those looking to protect their inventions on the moon and beyond. “The challenging environment of outer space bears limitations but also brings endless possibilities for innovation,” Vanessa explains. “However, just as space travelers need equipment unique to space, inventions created for outer space also need different patent strategies to minimize the risk.” Interested readers can access Vanessa’s article in IndustryWeek here: https://bit.ly/3XiKFNC

Thank you to Law.com reporter Michael Adam Mora for including our partner Cameron Pick in a story this week about OpenSea and its possible forthcoming lawsuit by the SEC. Cameron highlighted the significance of this news: “To go after the biggest NFT exchange is a signal to the public that not a few NFTs are securities, but any NFT is a security,” Pick said in an interview. “If you are representing a client who sells NFTs, they have to consider this as a potential risk. The risk has been in the back of people’s minds, but it has not been the same type of issue as creating a cryptocurrency.” Subscribers to Law.com can read more about the possible forthcoming case in The National Law Journal here: https://bit.ly/474xqol

Congratulations to Glenn Kaufman and the entire team at D Cubed Group LLC on their sale of KPS Global LLC, a leading insulated-panel and walk-in freezer manufacturer, to Germany’s Viessmann Generations Group. This incredible achievement not only marks the culmination of a 9-year period being built into a very special company but also highlights another step in the growth of KPS Global. Kudos to everyone involved in making this achievement possible! We are proud to partner with KPS Global to help guide its patent (mechanical, electrical, and design), trademark, and intellectual property transactions work, and to have supported the IP aspects of the due diligence for this acquisition. We look forward to many more years of working with the KPS Global team! Congratulations again from the Marshall Gerstein team: Jeremy Kriegel, Robert Gerstein, Michelle Bolos, Robert Jacobson, Brian A. R. Raddatz, Julie Muyco, Shannon Mastick, and Krista Solano.
We are excited to share the news related to our successful 9-year investment and business-building experience with KPS Global LLC. Today we announce our sale of the company after an almost decade-long period of significant revenue growth, increased profitability and product expansion. KPSG is now an over $400 million revenue business and the market leading provider of custom insulated panel systems in all areas of food retail as well as in the scientific and cold storage markets. This transaction, which represents a return to D Cubed investors of over 6x, caps the development of a category-defining company by D Cubed’s long-duration investment fund. We are proud to have created KPS Global by carving out two businesses and combining them with a plan to invest and build a company that could be enduringly great. As we note in the press release issued today, “Together with a great management team, who have been partners in every sense, we accomplished our plan to build KPS Global to operate at an entirely different level than had previously existed in its sector, and to grow in its historical market and markets beyond. We take tremendous pride in what has been accomplished with this investment, in the team, and in what the Company has become.” We are delighted to be transferring the company to Viessmann, a family business which shares with us a belief in long-duration ownership and building. And we are excited for the future of this special company and for its continued delivery of new, innovation-driven offerings to its best-in-class customer base across a growing number of markets.
