Mr. Gaetano DiPersia is an associate at McOmber McOmber & Luber, P.C. Mr. DiPersia’s primary areas of practice are commercial litigation, employment law, class action disputes, and business litigation. A 2022 graduate of Villanova Law School, Mr. DiPersia started his practice at a Philadelphia area law firm, where his focused practice area was commercial litigation disputes. This included, but was not limited to, litigating contract disputes mainly in the construction and trucking industries. While at Villanova Law, Mr. DiPersia was a student attorney in the Federal Tax Clinic, where he represented underprivileged individuals in disputes with the IRS. Additionally, he was a research assistant for the COVID-19 Legal Research Project, where he provided university employees with legal information regarding foreclosure and landlord issues during the COVID-19 Pandemic. "It has been a privilege to be a part of the team of attorneys at MML, fighting for those who otherwise would have no redress for wrongs experienced in the workplace. Providing a voice for employees who have suffered at the hands of their employer is what this profession is all about, and being able to stand up for the rights of workers throughout the state has been an extremely rewarding experience both professionally and personally. I am proud to be a part of a group of talented and passionate attorneys who fight on behalf of our clients day in and day out." Visit njlegal.com/team to learn more.

  • When Does Sexual Harassment Constitute a Hostile Work Environment? It is important to note that annoyances, petty grievances, and minor isolated incidents from employers or coworkers may not constitute illegal harassment. A hostile work environment exists when several legal criteria are met, including: ❗️An employer or coworker’s sexual harassment is severe, pervasive, intimidating, or abusive. ❗️The employee feels their job is in danger if they do not endure the sexual harassment. ❗️Sexual harassment involves discrimination against a protected class. You might think that sexual harassment in education rarely happens, but a shocking two-thirds of students in higher education experience sexual harassment at some point in college. The U.S. Department of Education utilizes Title IX to prevent and remedy acts of sexual harassment in education settings, and it protects students, staff, and faculty. The majority of K-12, college, and university campuses must have a Title IX coordinator in place whose job it is to respond to allegations of sexual harassment and other forms of sex discrimination. Luber, the two officers’ attorney, described the Trenton department as a “toxic, male-dominated environment and they were subjected to egregious discrimination, harassment, and retaliation.” “The notion that such behavior could occur in any workplace, let alone within the Trenton Police Department, is truly concerning. We are very proud of our clients for their courage in bringing the alleged conduct to light,” he said. “They look forward to their day in court.” Learn more about the case: https://ow.ly/G0VA50TeJQf
