On October 14, 2024, a proposed settlement was filed in a twelve-year antitrust lawsuit against Blue Cross Blue Shield (BCBS), where BCBS agreed to pay $2.8 billion to healthcare providers. In addition to the historic monetary compensation to class members, the settlement requires BCBS to invest hundreds of millions of dollars in “never-before-available changes” to its system. The timeline for finalizing the approval of the settlement is still being established but is expected to extend into mid-to-late 2025. A federal judge in the Northern District of California partially dismissed a consumer class action, concluding that the plaintiffs' reliance on total organic fluorine (TOF) testing was insufficient to prove that "pure cotton" tampons contained PFAS. The court found that TOF, while detecting organic fluorine, does not conclusively prove the presence of PFAS without targeted analysis.
