The building is currently a vacant retail space where the dispensary will provide both an aesthetic upgrade and cannabis tax revenue to the municipality. The New Jersey Economic Development Authority (NJEDA) will hold their September Board Meeting today at 10AM in Newark, NJ. Among other items, they will vote on a new Aspire application for a residential development in Somers Point, NJ and a Historic Property Reinvestment Program (HPRP) project in Atlantic City. To date, the Aspire program has awarded over $2bn in tax credits to 19 developments in municipalities across New Jersey, including Newark, Woodbridge, Morristown, Hoboken, Union City, and Bayonne, Trenton, Camden, among others. If approved, the historic project in Atlantic City would join the Loews Theater in Jersey City as the second HPRP development. The application is now open for the Historic Property Reinvestment Program, a competitive $50m gap financing tax credit. Have a historic property development in New Jersey that needs additional funding? Applications open tomorrow (9/10) for the Historic Property Reinvestment Program (HPRP), a competitive $50m gap financing tax credit program available through the New Jersey Economic Development Authority (NJEDA). To qualify, a building must be registered or identified as a historic resource by the host municipality, and should not have commenced construction. Qualifying projects can receive an award of 50-60% of eligible costs (not to exceed $8-$12m) which may be combined with other tax credits, including the federal Historic Tax Credit and the NJEDA’s Aspire program. Transformative projects qualify for 45% of eligible costs up to $50m. During the last application cycle, the NJEDA approved an award of $42,272,559.90 for the Loews Theatre in Jersey City. In the past year and a half alone, Murphy Schiller & Wilkes LLP has secured over $300m in tax credits for clients from the NJEDA. We would be happy to discuss how one might use the HPRP or the Aspire program to help fund a project in need of gap financing.

Reminder: CTA Compliance Deadline Approaching! On January 1, 2024, the Corporate Transparency Act (CTA) officially took effect. Pursuant to the CTA, most companies are now required to disclose beneficial ownership information for any person or entity owning a 25% or more direct or indirect interest in a company (a “Beneficial Owner”), as well as information identifying all executive decision makers and/or those parties having substantial control over the company, to the Financial Crimes Enforcement Network (FinCen) of the United States Department of Treasury. The December 31, 2024 deadline is fast approaching. Starting in 2025, FinCen will increase enforcement of penalties for failure to comply, including civil penalties of up to $500 for each day a violation remains uncured, criminal fines of up to $10,000 and/or possible imprisonment not to exceed two years.
