The New York City Bar Association (www.nycbar.org) is a voluntary organization with 24,000 members. Since its founding in 1870, the City Bar has been dedicated to maintaining the high ethical standards of the legal profession, promoting reform of the law and providing service to the profession and the public. The City Bar's 150 Committees issue hundreds of reports and present hundreds of events annually. The Legal Referral Service matches vetted lawyers with clients. The City Bar Center for CLE provides continuing legal education for lawyers. The City Bar Justice Center provides pro bono legal services to the disadvantaged. Protecting the public’s welfare remains one of the Association’s highest priorities.

    The New York City Bar Association has released an in-depth report on Congress's power to create an enforceable ethics code of conduct for Supreme Court Justices. The need for Supreme Court Justices to comply with the highest ethical standards is a nonpartisan issue because, as the Supreme Court itself has emphasized, public confidence in the integrity and neutrality of the courts is a bedrock principle of the rule of law. Congress’s power to impose an enforceable ethics code on the Supreme Court comes from Article I’s Necessary and Proper Clause, Article II’s impeachment provision, and Article III’s provision that a judge may remain in office only during “good Behaviour.” The Necessary and Proper Clause permits Congress to create a binding and enforceable Supreme Court ethics code to define the “good behavior” that entitles a Justice to stay in office and to set standards that, if violated, could lead to impeachment.  The enforcement mechanism for the Code of Conduct should consist of a Judicial Investigation Panel and Office of Inspector General for the Supreme Court. The separation-of-powers doctrine does not limit Congress’s ability to create a Supreme Court ethics code that does not affect its decisional independence. A judicial ethics code enacted by Congress but enforced by the judicial branch simply implements the checks and balances that lie at the core of our constitutional system.   • An increasing number of states are enacting policies hostile to LGBTQ youth, like book bans and restrictions on participation in sports. Even in states like New York where there is greater state-level support for LGBTQ rights, similar policies aimed at stifling those rights have emerged at the local level. Amy Leipziger (Project Director, @freetobeyouthproject), Ashton Hessee (Legal Fellow, Free to Be Youth Project) and Gabriella Larios (Staff Attorney, @NYCLU) of the City Bar’s LGBTQ Rights Committee unpack the damage to psychological and physical health that these bans and the anti-LGBTQ culture that they promote can have on LGBTQ youth – kids who are navigating the same developmental challenges as their peers while being saddled with these additional burdens. Amy, Ashton and Gabriella also speak to how queer and trans youth – and their parents and caregivers – can understand their rights and understand how to advocate for their rights in school. All three share stories from the frontlines of litigating against these bans, and share insights on the most effective strategies for pairing litigation with grassroots community organizing.
