Congratulations to Stephen A. Berrios, Kristine S. Phillips, and law clerk Antonio Zuniga for obtaining summary judgment for their client in the Circuit Court of Cook County last week! Our astute attorneys defended against a former employee’s claims that alleged the employer breached the employee handbook and intentionally caused severe emotional distress, when the employer responded to plaintiff’s coworkers circulating a petition asking for plaintiff to be terminated for inappropriate racism and bias. After initially obtaining a dismissal with prejudice for defamation and negligence causes of action at the pleading stage, the court then agreed with the arguments presented for the employer on summary judgment and found that the employees engaged in a protected activity and that the response was a reasonable exercise of business judgment.
