Payton Employment Law, PC and its team take special pride in assisting victims of unlawful conduct in the workplace, whatever form that it takes. The Firm handles all types of employment cases for its employee clients, including cases arising from an employer’s discrimination, harassment, retaliation, wrongful termination, unpaid wages, overtime, and commissions, failure to provide legally compliant breaks, and other violations of the California Labor Code. The Firm also handles wage and hour class action and Private Attorneys General Act (“PAGA”) matters in cases where violations of the California Labor Code of widespread which affect many employees. The Firm represents employees of all professions, and in all stages of their career, in navigating workplace disputes and aggressively advocating for financial compensation when employers have failed to follow the law.   • 🏳️🌈 Celebrating LGBTQ+ History Month! 🏳️🌈 Every October, LGBTQ+ History Month shines a light on the rich history and remarkable achievements of lesbian, gay, bisexual, transgender, and queer individuals. This meaningful observance was initiated by Rodney Wilson, a dedicated history teacher at a Missouri high school, back in 1994. The significance of LGBTQ+ History Month was formally recognized the following year when it was added to the list of commemorative months, thanks to a resolution put forth by the General Assembly of the National Education Association. The choice of October was particularly fitting as it already featured National Coming Out Day on October 11, a pivotal day in the LGBTQ+ calendar. October also holds historical significance as it marks the anniversary of the first march for gay rights in Washington, which took place on October 14, 1979. At our firm, we've had the privilege of fiercely advocating for countless LGBTQ+ employees who have been subjected to discrimination and harassment in the workplace. California Government Code Section 12940 makes it unlawful for employers to discriminate against or harass employees based on their "sex, gender, gender identity, gender expression, [or] sexual orientation." We are truly grateful to serve as advocates for those who have faced unequal treatment simply because of their LGBTQ+ identity.   • Our Managing Shareholder, Chantal McCoy Payton, was quoted in Law360's article about our recently filed class action case against Billion Dollar Baby Entertainment LLC. In August, Payton Employment Law, PC filed a lawsuit against Billion Dollar Baby Entertainment, LLC after its production team refused to pay our client, Ms. Rebekka Lien, proper minimum and overtime wages, threatened to withhold pay entirely, and substantially restricted meal and restroom breaks during the production of rapper DaBaby's “Couple Cubes of Ice” music video. The proposed class action was filed on behalf of Lien and other unpaid or underpaid dancers, performers, models, actors, actresses, and background talent that were filmed in, participated in, or worked on any of the record label’s music videos in the State of California. Beyond restricting communication and movement, DaBaby’s production team exerted complete domination over music video’s cast’s time, schedule, and their ability to eat, drink, rest, use the restroom, and communicate with the outside world during the period of employment, the suit says. Despite an utter lack of independence, Billion Dollar Baby misclassified performers as independent contractors in order to skirt the California Labor Code, which mandates employers’ strict adhesion to meal and rest break rules and minimum wage and overtime compensation requirements for employees.
