Important Florida Case Law Update: Desbrunes v. U.S. Bank Yesterday, Florida’s Fourth District Court of Appeal granted rehearing, withdrew its prior opinion, and affirmed the entry of judgment in the case of Desbrunes v. U.S. Bank. David Rosenberg, RAS’s Senior Appellate Counsel and Associate General Counsel, co-authored an amicus brief in support of the appellee’s motion for rehearing. Yesterday’s opinion adopts RAS’s argument that homestead property “passes outside any administration of the decedent’s estate,” and thus the personal representative has no interest in the property and need not be joined to the foreclosure action. RAS is thrilled with this result and is proud to have been a part of the team behind this impactful decision.
