Big update: The most immigrant-friendly country is set to cut down the number of PRs issued by 20%. Context: In a shift from Canada’s traditionally welcoming immigration policy, Prime Minister Justin Trudeau announced temporary restrictions on immigration targets. This marks a reversal from Canada’s previous—and is happening due to the rapid population growth, housing shortages, and economic pressures. ✅ Caps on PRs for the next 3 years - 2023: 465,000 - 2024: 485,000 - 2025: Reduced from 500,000 to 395,000 - 2026: Reduced from 500,000 to 380,000 - 2027: 365,000 ✅Caps on no. of international student visas - 2023: 509,390 permits issued - 2024: 485,000 (35% reduction) - 2025: 437,000 (additional 10% cut) - 2026: Cap to remain at 437,000 ✅Changes to work permits - Stricter rules for companies hiring foreign workers - Companies must prove inability to hire Canadian workers first India currently leads immigration to Canada, representing 25% of all immigrants. So these new policies will create a tougher landscape for Indians looking for PR, study permits, and work permits. “Today’s Immigration Levels Plan for 2024-2026 sets out our targets for immigration over the next three years. By stabilizing the number of newcomers, we recognize that housing, infrastructure planning, and sustainable population growth need to be properly taken into account,” shares Immigration Minister Marc Miller. “Through this plan, we are striking the appropriate balance to grow Canada’s economy, while maintaining our humanitarian tradition, supporting Francophone immigration, and developing a more collaborative approach to levels planning with our partners. Canada will continue to welcome newcomers and ensure that they are supported in their new lives.” … Please re-share this post so it helps more people! 🙏 If you would like to learn more about talent visas like EB-1a, NIW, O-1, check out-https://lnkd.in/eWRuhAMB and https://www.greencard.inc/ . #CanadaImmigration #GlobalMobility #ImmigrationPolicy #CanadaPR #immigration #studentvisa #unshackled #internationalstudents

It’s official: Donald Trump is the 47th President of the United States. While there are many speculations around what policies will get implemented in the coming years, esp. concerning high-skilled immigrants, I just wanted to clarify what a President can and cannot do—so there’s no misinformation. ❌ What a President CANNOT do - Take away an existing visa: This requires a law to be passed thru Congress. E.g. President cannot take away the F-1, OPT, H-1B, or any other visas. (He also cannot grant green cards to college grads!) - Cut existing visa numbers/categories: E.g. President cannot decrease the number of green cards or H-1B visas given out each year. - Override the U.S. Constitution. E.g. In 2020, when the President tried to end protections for DACA recipients, the courts blocked it. ✅ What a President CAN do - Publish executive orders. E.g. Presidents have used this power to both benefit immigrants positively (e.g. H-4 EAD program) as well as not-so-positively (e.g. ‘Buy American, Hire American’) - ^Similarly, Presidents can also repeal executive orders published by previous Presidents. - Add additional administrative requirements to established USCIS processes—which can make it easier or harder to get a visa approved. 👉 If you’re an immigrant/international student, two things: - Join a free webinar with me + an immigration lawyer next week addressing your queries/concerns: https://lnkd.in/gpkautn7 - Join the Unshackled weekly newsletter with 22,000+ to stay on top of news & policy changes as they happen: https://lnkd.in/gXzfuj74 In the end, I *hope* history doesn’t repeat itself, and Trump’s stance on high-skilled immigration has changed for the better. How 🦉 Mayank Bansal did the impossible!

From facing three H-1B rejections to securing an O-1A visa—all in just four months! In April 2021, 🦉 Mayank Bansal found himself at a crossroads. After three H-1B rejections, with only four months left on his STEM OPT, his American dream was on the line. The choice was tough: go back to India or find another way. "You still have four months to figure something out,” his father told him. “Knowing you, I know you will." That’s when Mayank discovered the O-1A visa option. And within 3 months, he got it approved. Here’s how he did it: ✅ Step 1: Convincing your employer Mayank created a detailed plan to convince his employer He researched requirements, consulted a lawyer, & made a plan that minimized company effort Want a free guide on the O1? Check https://lnkd.in/eY5psdiE ✅ Step 2: Documents. Documents. Documents. The O-1A requires EXTENSIVE document collection. So he: - Searched through Google Drive and old emails - Retrieved TV interviews he’d given 5+ years ago - Gathered press clippings from seven years ago - Even had his parents look through old binders for newspaper clippings ✅ Step 3: Get recommendation letters The O-1A generally requires 3-7 letters. So he: - Reached out to professors / managers / ex-company founders - Sent emails with subject line "URGENT: Need Recommendation Letter for O-1A" - Almost everyone said yes! ✅ Step 4: Sending it to USCIS You need to physically mail your application! - Mayank compiled 6 lbs of documentation - Paid for premium processing (result within 15 days) - Sent to the California processing center After 11 intense days of waiting… he got the approval :) 💡 Buuut, Mayank also had 3 backup plans: - Canada (intra-company transfer) - Ireland (offer from another company) - India 🎁 If you’re looking for an in-depth guide on the O-1A, check: https://lnkd.in/g7ix4bkC Please re-share this post to help others facing visa challenges! 🙏 #unshackled #immigration #O1Visa #entrepreneurship #success #india #resilience #careerjourney #studentstruggles

90,415 Indians were detained at U.S. borders in FY2024, averaging 10 arrests per hour. Context: While overall illegal border crossings have decreased from 3.2 million to 2.9 million in the past year, the number of Indian nationals, particularly from Gujarat, attempting unauthorized entry has risen dramatically. This year’s number was a slight decrease from last year (96,917). This shift reflects both changing global migration patterns and the increasing complexity of immigration challenges facing both nations. ✅ Key highlights: - A total of 90,415 Indian nationals were detained at U.S. borders during FY2024 - About 50% of these arrests (43,764) happened at the U.S.-Canada border—the highest number of Indian nationals ever caught at this border - On the other hand, the arrests at the U.S.-Mexico border decreased significantly from 41,770 to 25,616, due to increased surveillance - Finally, of the 90,415 Indians, about 86% were single adults, 13% were families, and ~1% were unaccompanied children. Interesting note: The Wall Street Journal says that nearly all Indians illegally entering the U.S. turn themselves into Border Patrol to avoid getting arrested. This is so that they can apply for asylum in the United States. Despite these arrests, the people who get caught reflect only a small % of those who succeed in entering illegally. EB-5 Visa: A Reliable Pathway to the American Dream for Indians Amidst H-1B Uncertainty 🇺🇸🌟 Amid H-1B visa challenges, the EB-5 Investor Visa offers Indians a secure route to U.S. residency. By investing in the American economy, you can earn a Green Card, support job growth, and seize new opportunities. Here’s how the EB-5 program aligns with the priorities of Indian investors: 1. Direct path to green card : - The EB-5 program provides a streamlined process to achieve U.S. residency. - Begin with the I-526 filing, and after approval, finalize with the I-829 to gain permanent residency for you and your family, including children under 21. 2. Freedom to choose your career : - Unlike the H-1B, which limits you to specific employers, the EB-5 visa offers flexibility to work in any field, granting you the freedom to pursue diverse career paths across the U.S. 3. Predictable processing timeline: - Processing times range from 29.5 to 61 months, with an option for concurrent filing if already in the U.S. - This enables you to start working and traveling without the renewal hassles that come with the H-1B. 4. Secure investments with regional centers: - USCIS-approved Regional Centers manage EB-5 investments to ensure job creation requirements are met, securing your investment and your pathway to residency. 5. Investment and return timeline: - The EB-5 program mandates a minimum investment of $1.05 million (or $800,000 in rural or high-unemployment areas). Though investment returns are often projected within five to seven years, this timeline is not assured and can differ by project. - The main objective of the EB-5 investment is to obtain U.S. residency by supporting U.S. economic growth and job creation, rather than to yield significant profit. US tax rules perplex Indian students seeking H-1B visas!! Indian students studying in US universities are facing a perplexing tax situation arising from conflicting interpretations of residency rules following their 5-year F-1 visa tax exemption period. This issue becomes particularly challenging when transitioning to H-1B visas, creating a "residency enigma" with significant financial implications. ✅ Essential Points: - Students must prove their intent to return to India after 5 years to maintain tax non-resident status. - Some US tax experts interpret H-1B applications as a step towards permanent residency, affecting tax classification. - This interpretation could result in higher taxation and requirements for global asset disclosure for students. ✅ The Ongoing Debate: - Does submitting an H-1B lottery application signify an intention to become a permanent resident? - Is it fair to subject students to more stringent tax rules before H-1B approval? ✅ Potential Impacts: - Increased tax burden - Extensive paperwork for declaring global assets - Risk of penalties for non-compliance This situation exemplifies the complex interplay between immigration policies and tax laws. It's vital for students to consult experts to successfully navigate these challenges.
