    The USCIS has outlined Cap-Gap extension rules, a crucial provision for F-1 students transitioning to H-1B status in the United States. The Cap-Gap extension bridges the gap between F-1 OPT expiration and H-1B start date, typically October 1. It ensures eligible students maintain legal status and work authorization while awaiting H-1B approval, benefiting both international students and their employers. Key points that you need to be aware of: 1. Cap-subject H-1B petitions are filed for eligible F-1 students requesting change of status. 2. Cap-Gap extends from F-1/OPT expiration to October 1 H-1B start. 3. No separate application or new EAD required for cap-gap extension. 4. Extension ends if H-1B petition denied, withdrawn, revoked, or not selected. 5. 60-day grace period applies if extension terminates, except for status violations. It is advisable to stay in close contact with your petitioning employer and monitor your petition status regularly This provision offers a vital safety net for F-1 students transitioning to H-1B status, ensuring continuity in their U.S. stay and often in their employment.     USCIS unveils new F-1 visa regulations, significantly restricting students' time outside the US. Recent updates to F-1 visa regulations have introduced stricter limits on time spent outside the US. The F-1 visa is a non-immigrant visa for international students in the US. Until now, students were allowed to travel outside the US for various reasons, including holidays, study abroad, and internships. However, new rules are restricting the time a student can spend outside of the US. This affects study abroad plans, internships, and academic breaks for international students. Key Changes: 1. Students are now limited to a maximum of five consecutive months outside the US during their academic programs. 2. The new rules impact study abroad programs, international internships, extended research projects outside the US, and even academic breaks. 3. Exceeding the 5-month limit risks students' visa status, potentially forcing them to forgo valuable international experiences and creating challenges for programs that depend on international mobility. 4.     Great news: The U.S. Court of Appeals sided with immigrants to continue letting spouses of H-1B holders work in the U.S. Context: "Save Jobs USA" has been in a years-long battle with the U.S. government, trying to take away the H-4 EAD program letting certain immigrant spouses work. Fortunately, a few days ago, the U.S. Court of Appeals for the District of Columbia endorsed the legality of the rule permitting spouses of H-1B holders to work in the U.S. (Major tech firms like Google, Amazon, and Microsoft backed this rule as it helps attract and retain skilled immigrants.) Some background: In 2015, the Obama administration signed an executive order allowing a *subset* of spouses on the H-4 dependent visa to obtain an EAD card to start working. Until then, these dependents—mostly women from India—were not allowed to work. Since 2015, over 100,000 dependents have applied for and been approved for work authorization. When the Trump administration took over in 2017, they planned to end this ruling, which would have affected not just the 100,000+ spouses but their entire families. Several lawsuits were filed against the H-4 EAD program by organizations such as Save Jobs USA over the years. One such lawsuit was resolved last week. In upholding the district court’s decision, Circuit Judge Justin R. Walker wrote for the court, “This court has already interpreted the relevant provisions of the [Immigration and Nationality Act] to answer a similar question in favor of DHS” in the litigation challenging Optional Practical Training (OPT) for F-1 students. “Because Save Jobs USA has not meaningfully distinguished this case from that binding precedent, we affirm the district court’s grant of summary judgment.” The decision will ensure companies can continue to leverage international talent and address skill shortages.
