In #AI #legal developments, last week's order by the Delaware Supreme Court, "In re Interim Policy on the Use of Generative AI by Judicial Officers and Court Personnel," is interesting because, as the name implies, it differs from most of the court orders we've seen in that--rather than limiting or requiring the disclosure of the use of #GenerativeAI by litigants and counsel--it governs its use by #judicial officers and #court personnel. (Thanks to Senior U.S. District Judge Nora Barry Fischer for the copy of the order below): https://lnkd.in/ejAyJ-Sf Relativity #LegalEducation

How can lawyers build confidence in AI’s usability and defensibility for themselves? The legal community’s universal hunger for reliable standards and their tendency to collaborate on establishing and sharing these standards can help. Tara Emory, currently Special Counsel at Covington & Burling LLP, recently coauthored an article in The Sedona Conference Journal — alongside Jeremy Pickens and Wilzette Louis — that aims to “provide a reference model to serve as a foundation for first-pass workflows that use artificial intelligence/machine learning to integrate them into the established process of TAR.” We are seeing #ediscovery practitioners leveraging what they’ve learned from older models of technology-assisted review — known as predictive coding, which arrived on the scene more than 10 years ago — and applying it to generative AI. They’re using established precedent to obtain greater efficiencies via contemporary technological innovations. https://ow.ly/lTY650TTLqm
