For more than three years, Rothwell Figg has been fighting on behalf of pro bono client Bethesda African Cemetery Coalition ("the Coalition") to halt the sale of the Moses African Cemetery, an African American burial ground in Bethesda, Maryland. In the August 30 decision from the Supreme Court of Maryland, the majority opinion found that Maryland common law prohibits desecration of the remains of the dead and that the Coalition could amend its complaint to assert claims for such desecration and to seek injunctive and other equitable relief against continuing desecration of the Moses African Cemetery. In the span of just over a year, substantively similar claims of patents having the same disclosure were invalidated on distinctly different grounds at the U.S. Supreme Court and the Unified Patent Court. The standards articulated create two competing - and even contrasting - conditions to be met for patentability and for invalidating existing patents. So what's an applicant to do? In navigating the matrix, Rothwell Figg attorney Michael Ellenberger lays out what patent applicants may want to consider in their patent applications.
