The Centers for Medicare & Medicaid Services (CMS) has announced the negotiated prices for the first 10 drugs selected under the Medicare Drug Price Negotiation Program (https://lnkd.in/e2EJQYHJ). The Inflation Reduction Act (IRA) of 2022 granted Medicare the ability to directly negotiate the prices of certain single source drugs without generic or biosimilar competition that have been FDA approved for 7 to 11 years. CMS engaged in negotiations with the manufacturers of 10 selected drugs covered under Medicare Part D to arrive at what the statute refers to as Maximum Fair Prices (MFPs). The prices will go into effect beginning January 1, 2026. It is important to note that the negotiated discounts suggested by CMS are off of list prices, not net prices, with many of the selected products already being heavily discounted via rebate contracts with Part D sponsors (MCOs and PBMs). Therefore, CMS’s suggested discount amounts are overstated. CMS will provide the public with details on the key factors used to determine pricing offers for the first group of selected drugs by March of 2025, and for drugs that are likely to be selected for the second cycle of negotiations, it will be important for manufacturers to evaluate the approach CMS took. The next group of products (15 additional Part D drugs) will be selected by CMS for price negotiations by February 1, 2025, with those prices announced by November 30, 2025, and going into effect January 1, 2027. From SciVida's perspective, there are several uncertainties to monitor and evaluate. First, there are the unintended consequences that could result from the IRA’s drug pricing provisions, such as the potential decrease in investment in and development of small molecules due to IRA favoring biologics, since biologics are spared from price negotiations for 11 years following approval, while small molecules only receive 7 years. The potential also exists for higher prices at launch due to elements of the IRA that limit price increases after launch and the fact that the setting of MFPs effectively truncates the window for manufacturers to realize a return on products developed and launched. Second, it is unclear what the potential impact will be on utilization of the 10 selected products in Medicare (Part D and Medicare Advantage) and coverage and utilization of other branded products that compete with the selected drugs. Third, we will need to watch how pricing and market access dynamics may evolve in commercial managed care vis-à-vis the setting of MFPs in Medicare Part D (e.g., if pricing in commercial gravitates toward MFPs, how PBMs will approach the situation). As we approach the first year the negotiated prices take effect, it will be critical for manufacturers to understand how the market is expected to respond and any potential measures that can be taken now to stem the IRA’s impact.

While the firm’s west coast team headed to Napa, SciVida's east coast team, led by SciVida Co-Founder and Managing Partner Kevin Barnett and Partner Rachel Clare, headed to Charlottesville, VA, for their two-day summer fun event. The group started with a fun wine blending competition at Eastwood Farm and Winery, where team names like the SciVinos and SciVignons may or may not have prevailed with winning meritage blends. Additional activities included kayaking, canoeing, playing lawn games, and exploring the University of Virginia campus, and team members raved about the Turkish, French, and traditional southern cuisines that all enjoyed over the course of the trip. SciVida Co-Founder and Managing Partner Jeff Liepman also joined for the event. All had a great time!
